Court Ordered Utusan Malaysian To Pay Guan Eng RM 200K For Defamation

Court Ordered Utusan Malaysia to pay LGE RM200,000 in damages and RM25,000 in costs.


KUALA LUMPUR, Dec 14 — The High Court today foundUtusan Malaysiaguilty of making “malicious”, defamatory and untruthful statements against Lim Guan Eng, and ordered the Umno daily to pay him RM200,000 in damages and RM25,000 in costs.

Justice G.V Varughese, in an hour-long judgment delivered in Penang, outlined seven paragraphs in an Utusan article titled “Kebiadapan Guan Eng” in which the paper had “maliciously defamed Lim (picture above), and made him and the DAP look as if they are anti-Malay and anti-Islam.”
“The judge ruled that the defendant showed selective vendetta against DAP and the plaintiff,” Lim’s lawyer Jagdeep Singh Deo told The Malaysian Insider
“The ruling stated that Utusan had shown disdain for the highest standards of responsible journalism,” added Jagdeep.
The lawyer said, among other things, the article had accused the Penang chief minister of “attacking Malay institutions, being racist, being opposed to Malays, demolishing Malay stalls and villages, and cancelling the state’s Maulidur Rasul celebration.”
“The learned judge, after listening to witnesses brought in by both sides, ruled that Utusan’s allegations were malicious and not factually true,” added Jagdeep.
Lim, who is also Bagan MP and Air Putih assemblyman, filed a suit against Utusan for publishing allegedly defamatory words in the article.
In his statement of claim, the Penang CM said the words used, among others, were meant to portray him as a racist who objected to anything related to Malays.
In an immediate response, Lim said that Utusan should take heed of this incident and avoid slanderous reporting in the future.

Datuk Seri Najib risks Malaysia's reputation in his treatment of Anwar Ibrahim

If the opposition leader is convicted of sodomy he will become yet another victim of an egregious, politically suspect injustice: Report By Simon Tisdall On Tuesday 13 December 2011.

The portents do not look good for Malaysia's opposition leader, Anwar Ibrahim, whose trial on highly dubious sodomy charges draws to a close this week. If Anwar is found guilty – and the trial judge seems to have made up his mind already – he will not be the only or even the most important victim of an egregious, politically suspect injustice. Malaysia's democratic reputation will have been critically wounded, and for that outrage, Malaysians will have their prime minister, Najib Razak, to thank.

The plodding Najib's overriding objective is winning the general election expected next year, possibly within a few months. The son of Malaysia's second prime minister, the nephew of its third, president of the dominant United Malays National Organisation (Umno), and a former defence minister, Najib was born to power and is accustomed to wielding it. As the charismatic leader of the opposition coalition, Anwar represents the biggest challenge to his continuing ascendancy.

It hardly seems coincidental that the sodomy charges were levelled at Anwar shortly after the opposition inflicted unprecedented defeats on Umno and its allies in the 2008 elections. Anwar's main campaign plank – combating the official, institutionalised discrimination that favours ethnic Malays over the country's large ethnic Chinese and Indian minorities – threatened the post-colonial order that has kept Umno and its National Front coalition on top since 1957.

In a court appearance earlier this year, Anwar, 64, a married father of six, denied accusations he had had sexual relations with a former male aide. Homosexuality is punishable by law in Malaysia by caning and up to 20 years in jail. The allegations were "a vile and desperate attempt at character assassination" and a "blatant and vicious lie" spread by his political enemies, he said. "This entire process is nothing but a conspiracy by Najib Razak to send me into political oblivion by attempting once again to put me behind bars."

Najib flatly rejects the idea of a political vendetta. But the recycling of sodomy accusations – Anwar was jailed on a similar charge in 1998 and detained until the conviction was quashed in 2004 – suggests a lack of originality characteristic of the prime minister. The case turns on the testimony of the alleged victim and DNA evidence produced by the prosecution. Defence lawyers suggested this week that Anwar's accuser was a "compulsive and consummate liar" who may have been put up to it. Yet the trial judge has already declared the prosecution's evidence "reliable" and credible", leading Anwar to claim he is being denied a fair trial.

Najib gives every appearance of preparing for snap polls on the assumption that Anwar will be out of the way and the opposition decapitated. He told Umno's annual congress to prepare for battle because "the time is near" and urged delegates to work harder, for example by using social media, to attract a "new generation of Malaysians who are more critical and have rising expectations of the government". The party must adapt or face "tragedy", he warned.

To Najib's evident alarm, that tragedy almost occurred in July when tens of thousands of protesters took to the streets of Kuala Lumpur. The highly unusual public display of discontent was spurred by a range of factors: spending cuts, official corruption and cronyism, a defective electoral system, curbs on public assembly and debate, and state-imposed censorship considered draconian even by regional standards. The example of recent political upheavals in neighbouring Thailand and Singapore also played a part. In response, thousands were beaten and detained by police.

Now Najib is taking no chances as his lieutenants warn that Anwar is fomenting an Arab spring-style uprising – a so-called "hibiscus revolution". Having more or less reneged on shaky, post-July promises of civil rights reform, Najib is now pushing through remodelled restrictions in the form of the Peaceful Assembly act.

The act effectively makes peaceful assembly impossible by restricting it to undefined "designated places". No gatherings are permitted within 50 meters of prohibited places including hospitals, schools or places of worship. The police can dictate the date, time and place. Najib's idea of engaging the "new generation" of young Malaysians is to ban anyone under the age of 21 from organising a protest.

Opposition parties, lawyers and activist groups have condemned the new law, as has Amnesty International. But Khairy Jamaluddin, Umno's youth-wing leader, articulated Najib's paranoia last month when he accused Anwar's coalition of "trying hard to manufacture panic and disorder" by promoting street rallies instead of elections. "The opposition often quotes social movements in the Middle East to instigate people to take part in street revolutions and in the process manufacture a Malaysian version of the Arab spring," Khairy said.

Najib's authoritarian tendencies, blatant political scaremongering, and the judicial travesty that is Anwar's trial all suggest Malaysia's western allies, including Britain and the US, should take a closer look at their friend. Malaysia is valued as a trading partner, counterproliferation collaborator, and noncombatant member of the Afghanistan coalition. But the government's human rights record and democratic practices merit closer scrutiny.

In a visit last year, US secretary of state Hillary Clinton extracted a promise that Anwar would receive a fair trial. "The US believes it is important for all aspects of the case to be conducted fairly and transparently and in a way that increases confidence in the rule of law in Malaysia," she said. In a recent speech, Clinton urged all states to end discrimination on grounds of sexual orientation.

As Anwar's ordeal approaches an ugly climax, it seems increasingly unlikely that these benchmarks will be met. The next question is: what will Malaysians and their friends do about it?

Najib Makes Nallakaruppan A Senator

This the quality of Malaysian Dewan Negara. Anyone who promises to slander Dato Seri Anwar Ibrahim will be made Senator. No doubt he will follow the footstep of Sengkatak Ezam who was made Senator just to slander Anwar few month back.

When I first read the news yesterday it did not stun me because it happened before. Its Najib tactic to smear DSAI name using his ex-righthand man or friends from Pakatan Rakyat. As for this KS Nallakaruppan who has been appointed as Senator by PM Najib, it is the worst blunder of Malaysian modern politic.

Najib and the Politic of Suppression in Malaysia

PM Najib, the son of Malaysian second Prime Minister took over the premiership from Tun Abdullah Badawi to become the sixth Prime Minister of Malaysia on 3rd April 2009.
He took over from his predecessor when BN strength was at its lowest level. During the 2008 General Election (GE 2008) Barisan Nasional (BN) lost four states to Pakatan Rakyat (PR) . All of the states except Kedah are the most developed states in Malaysia.
In order to win all of these states back from the PR, Najib has been employing the politic of suppression. Najib politic of suppression started in Perak . Two YBs from PR, both who were Malays became the first casualties. Najib with the help of  Malaysian Anti-Corruption Commission (MACC), had tricked the two YBs to accept bribes in the form of monies and prostitutes. Those two YBs were Jamaludin Mohd Radzi and Mohd Osman Mohd Jailu who were both from Parti Keadilan Rakyat or People Freedom Party (PKR). To avoid the prison, both of the YBs announced their defection and supported BN on 4th Feb 2009, and on the same date PR’s government in Perak collapsed.
After succeeded in Perak, Najib continued with his politic of suppression in Selangor. Using the same government agency the MACC, he harassed the PR YBs. Tan Sri Khalid was the first PR YB that was harassed . He was accused of corruption by using the state fund to buy cows for Haj festival in his constituency, and to service his personal vehicle. Both of the charges were proven not true and were dropped. Continued with their harassment in Selangor, MACC started to investigate and accused almost all of the PR YBs on corruption. The PR YBs could not spend their monies for political activities as the MACC were followings their every movements. The MACC operation in Selangor was put on-hold for a while after the death of PR political secretary the infamous Teoh Beng Hock murdered case. The inquest into the death of Teoh Beng Hock has been going on until now.

Najib Politic Will End Soonest

Najib politic of suppression is continuing until his own fall. Sooner or later, Malaysians will realize that BN and Najib is a dictator. Just like what had happened and happening around them, for example in Indonesia where people power had managed to force Suharto from his power, in Philippines Marcos was also ousted by people power (Najib and Rosmah combination is just like Marcos and Imeld). In Thailand, the Prime Minister was forced to step-down by the protester. Until now only in Myanmar and Malaysian government still manage to hold on to power despite the protests from people.
Sure Najib and BN Politic of Suppression Will be a Self Destruction to them!

In Malaysia, the “Reformasi” which had started with the rallies/protests since year 1998 to oust the BN dictator government , but until now still fail to bring down the government. In Myanmar, the protests led by monks in late 2007 nearly crippled the military junta.
In Malaysia, BN and Najib politic of suppression is still continued. But how long can they cheat the people? 1Malaysia concept that Najib introduced to unite it multi-races and religions in Malaysia, even though to Bukittunggal is just a rhetoric, is one of Najib strategies to avoid the people uprising.
To Najib and the BN, we have this to say :

Malaysian Home Minister Datuk Seri Hishammuddin Hussein and Wife Were Drinking Too!

A friend of mine this morning informed me about Malaysian Home Minister Datuk Seri Hishammuddin Hussein and Wife shown drinking beer at http://www.gutteruncensored.com/.
One of the man holding beer look familiar. Do you recognise him?
Here is his wife not to be confuse with his mistress enjoying a cold one too. She look totally wasted but she seem to be hotter than his mistress.(www.GutterUncensored.com)
This is supposedly one of his mistresses, the air stewardess that was caught having an affair with him in Johor Bahru. And she is said to be the same lady that he took to Mongolia on a trip with the then PM (http://www.gutteruncensored.com/)
Please see by yourself and make your own judgement whether this minister was sincere when he agreed with the punishments imposed on Kartika Sari Dewi Shukarno for drinking beer by the Syariah court? On supporting the punishments, Hishammuddin said :
“There was little force involved and it was not going to inflict pain, not even like the caning carried out in schools in those days.“I am now satisfied that the caning can be carried out by the department if the court decides to proceed and enforce the sentence,” .
Hishammuddin had recently said the ministry needed to study the proper procedures before caning the woman according to Syariah law, adding that he would not allow the department to execute the caning sentence ifit did not have the knowledge and expertise to do it. Kartika, a 32-year-old mother-of-two, was fined RM5,000 and ordered to be whipped six times for drinking beer in a hotel in Cherating last year. Her sentence has been deferred until after Ramadhan. Several parties, such as the Bar Council, have called for the sentence to be annulled. Hishammuddin said that although he was now satisfied that the department was able to conduct the caning, he still felt it had no experience to do so.
“This is because the woman (Kartika) will be the first to be caned (under Syariah laws applicable to Muslims). Four men who have received caning sentences by the Syariah Court are appealing their sentences,” he said.
On the merits of Kartika’s caning sentence, the minister said he had told the department not to get “embroiled in this.”
“That is not their purview. It is the judicial process which decides that. If the caning sentence is to be imposed, it is their duty to carry it out fairly.”
Kartika’s father, Shukarno Mutalib, when contacted, said the family was happy to hear that the department was able to handle the caning.
“Alhamdullillah (praise be upon Allah). Kartika wants it over and done with,” he said.
Will Hishamuddin and his wife be charged in Syariah court also ? This is Malaysia, a country that is rule by law!

Penanti By Election - PKR VS PKR Traitor +2 Inds

Penanti By Election is going to make history in Malaysian Politic as it is the first time that the  Barisan Nasional did not nominate any candidate in the contest. As for the reason why BN did not contest , no matter what reasons the new PM Najib gave but everyone knows that they are afraid to lose the losing battle or in another word , they are COWARD.....
Penanti is one of the State Assembly under Permatang Pauh constituency, and  one of Parti Keadilan Rakyat (PKR) stronghold. One basis of BN cowardness here is because they failed to fulfill few promises made during Permatang Pauh by-election held last year. In the election, Datuk Seri Anwar humiliated BN Candidate with bigger majority.
This by-election of which many believe is just an endorsement for PKR candidate. The PKR Candidate in this by election is a Penang PKR deputy chief Mansor Othman . Mansor, holds three Masters degrees, including two from Yale University. He is currently pursuing a PhD in philosophy. He had served as the political secretary to Anwar when he was deputy prime minister in the 1990s, and moved on to joined Keadilan after Anwar was sacked from Umno and the government in 1998. The former Keadilan Penang chief was also heavily involved in negotiations undertaken between DAP, PAS and PKR within the Pakatan coalition.
He is challenged by 3 Independent Candidates ; former Parti Keadilan Nasional (KeAdilan) Penang Wanita chief Aminah Abdullah, also 56, company manager and former Gerakan Telok Wang Branch Youth head Nai Khan Ari, 41, and motivational expert Kamarul Ramizu Idris, 42.
Although many believes that PKR candidate will win with comfortable majority, but personally I would like to urge all the PKR supporters in Penanti to work hard and win with bigger majority.

M'sia sets conversion rule - Religious Conversion Must Get Both Parents Consent

KUALA LUMPUR - MALAYSIA has banned the religious conversion of children without both parents' consent, news reports said on Thursday, in a major step to ease interfaith conflicts that have strained race relations in this Muslim-majority country.
The announcement by new Prime Minister Najib Razak's administration follows a string of high-profile legal spats in which people who embraced Islam also changed their young children's religion despite protests from their estranged non-Muslim spouses.
The disputes have sparked complaints of discrimination by non-Muslims because Islamic Shariah courts typically rule in favor of Muslims, while secular courts that preside over family matters for non-Muslims say they have no jurisdiction over such cases. Read more here.
