MACC -Teoh Beng Hock Murderer Retaliates


MACC Retaliated!

Last week court ruled that MACC should only conduct their interogations during office hours.
Today MACC's director of investigations Mohd Shukri Abdull reminded the public to make a report in the early hour of the day or after office hours, because according to him, during normal office hours their officers will be busy with their interrogations. Is it an act of retaliation by MACC followed a court orders or because of their officers stupidity or poor time planning ?
Personally I saw MACC and  their officerswere  incompetent and poor time management. Or their justification to get pay rise? Last week they made a controversial proposal  by suggesting that the Assemblymen allowance were to be increased to deter corruption among the assemblymen, short of making proposal to increase their salaries ....Stupid government officers.
In justify for their actions, Mohd Shukri said :

“We urge people who want to lodge reports with us or who want to give us their statements to come to the MACC office in the early morning or afternoon to avoid any inconvenience," said director of investigations Mohd Shukri Abdull.

Those who filed reports on a Friday evening would only have their statements recorded on Monday, he added.

MACC Retaliates to court decision

“It is not that we do not want to entertain the public at their convenience but we have to adhere to the court ruling that forbids us from interviewing witness after office hours,’’ said Mohd Shukri.
High Court judge Justice Mohamad Ariff Md Yusof declared in a landmark ruling last week that witnesses could only be questioned from 8.30am to 5.30pm each day.
The court decision came in the wake of a lawsuit Kajang municipal councillor Tan Boon Wah filed challenging MACC interrogation procedures.
Bukit Gelugor MP and lawyer Karpal Singh said crime suspects and witnesses could get off the hook if the police interrogated them outside office hours.

Pemantauan Pilihanraya Kecil Bagan Pinang-Kredibiliti Dua Agensi Kerajaan SPR dan SPRM(MACC) Dipertikaikan

Walaupun menurut Seksyen 19(1) (a) dan (b) Akta Kesalahan Pilihan Raya 1954, calon-calon yang bertanding dalam pilihan raya umum hendaklah berbelanja tidak melebihi had yang ditetapkan iaitu untuk calon Parlimen RM200,000 dan calon DUN RM100,000, tetapi setakat ini sejauh manakah SPR atau MACC memantau mana-mana calon pilihanraya agar mematuhinya.
Semenjak PU12-2008 sebanyak 9 pilihanraya kecil (PK) telah diadakan. Setiap kali ianya diadakan BN akan membelanjakan berjuta-juta ringgit di dalam bentuk perlaksanaan projek oleh BN demi untuk merasuah para pengundi. Daripada sembilan PK ini, BN telah berjaya memenangi 2 daripadanya. Dan dikedua-dua tempat di Batang Ai dan Bagan Pinang, BN telah merahsuah pengundi dan berjaya di dalam kedua-dua kawasan berkenaan. Di lubok Antu BN telah menabur projek pembangunan bernilai beratus juta ringgit di samping wang poket berjumlah ratusan ringgit untuk setiap pengundi. Di Bagan Pinang seperti yang dilaporkan oleh Sarawak Headhunter ,BN bukan hanya menggunakan wang saku serta projek pembangunan untuk membeli undi tetapi makanan kering juga turut telah digunakan.
Di sebalik bukti-bukti yang dilaporkan oleh bloggers, apakah tindakan kedua-dua ajensi kerajaan berkenaan? Sememangnya rakyat Malaysia serta dunia sedia maklum, bahawa hasrat kerajaan Najib untuk menghapuskan rasuah hanya rethoric semata-mata (tidak menghairankan kerana Najib sendiri merupakan pemimpin yang korup begitu jua kebanyakan pemimpin-pemimpin di dalam UMNO yang lain (malahan Tan Sri Isa sendiri yang baru memenangi PK Bagan Pinang merupan seorang pemimpin yang korup).
Cuba perhatikan sekiranya perkara yang sama berlaku kepada PAKATAN. Sedangkan saudara Teoh Beng Hock, hanya kerana mahu mengaitkannya dengan tuduhan rasuah bernilai kurang daripada RM 200, dia telah disiasat dengan tidak berperikemanusiaan serta menemui ajal.
Saya merasa tertarik dengan laporan yang dibuat oleh National Institute for Electoral Integrity (NIEI) dan disiarkan di dalam Merdeka Review bertarikh 12 Okt 2009. NIEI melaporkan seperti berikut :

National Institute for Electoral Integrity (NIEI) telah memantau perjalanan pilihanraya kecil (PRK) bagi kerusi DUN Bagan Pinang (N 31) bermula dari hari penamaan calon pada 3 Oktober sehinggalah berakhirnya proses pengundian pada 11 Oktober 2009.
Di dalam pemantauan pilihanraya, terdapat dua kaedah yakni stationary monitoring (pemantau ditugaskan untuk tunggu di setiap tempat mengundi) dan mobile monitoring (pemantau bergerak).
NIEI menggunakan kaedah mobile monitoring di mana pemantau-pemantau NIEI bergerak untuk memantau perjalanan pilihanraya di dalam kawasan N 31 bermula dari proses penamaan calon, tempoh berkempen dan hari mengundi.
Di dalam pemantauan NIEI di kerusi N 31, terdapat beberapa perkara yang telah mencemarkan PRK yang seharusnya telus, bebas dan adil. Di antaranya ialah:

1.Ketidaktelusan pengundian pos


Terdapat dakwaan bahawa senarai pengundi pos tentera yang diwartakan dan diberikan kepada calon-calon yang bertanding berbeza dari senarai pengundi pos tentera yang dipaparkan pada hari mengundi pos 8 dan 9 Oktober 2009.
Selain daripada itu, terdapat juga dakwaan bahawa terdapat pengundi-pengundi pos yang didaftarkan lebih dari satu kem serta pesara-pesara tentera masih lagi terdapat dalam daftar pengundi pos.Yang lebih menyedihkan lagi, SPR langsung tidak mengendahkan syak wasangka ini dan tidak membersihkan nama mereka dan maruah sebagai badan penggendali pilihanraya tidak dipertahankan.Oleh yang demikian, bagi memastikan proses pengundian pos tidak lagi dipertikaikan pada masa akan datang, NIEI mencadangkan agar kaedah dan prosedur pengundian pos hendaklah dikaji semula dan diubah supaya ianya telus dan diyakini oleh rakyat.
Dari pengalaman pemerhatian NIEI di luar negara, Thailand dan Filipina yang mengalami konflik ganas, pengundian secara normal digunakan bagi anggota tentera mereka. Pusat pengundian yang dikendali sepenuhnya oleh SPR - serta hak-hak yang sama bagi agen parti, pemantau tempatan dan pemerhati antrabangsa - dibuka di dalam kem-kem tentera.
Jika terdapat undi pos tentera, ianya akan dikendalikan sepenuhnya oleh SPR negara tersebut. Tidak timbul langsung kontraversi senarai nama pengundi anggota tentera di sana.

2. Rasuah politik, penyalahgunaan jentera kerajaan dan politik janji


Rasuah politik, penyalahgunaan jentera kerajaan dan politik janji masih lagi berleluasa dalam PRK N 31 Bagan Pinang. Pemberiaan projek-projek kerajaan kepada penduduk Bagan Pinang semasa tempoh berkempen dilakukan secara berleluasa. Banyak kementerian-kementerian seperti Kementerian Penerangan, Kementerian Pertanian dan Asas Tani, Kementerian Pendidikan serta Kementerian Perdagangan Dalam Negeri dan Hal Ehwal Pengguna digunakan untuk memberikan "rasuah politik" kepada pengundi Bagan Pinang secara terbuka.
Selain daripada itu, penyalahgunaan jentera kerajaan turut dilakukan secara berleluasa. Kedua-dua pihak yang bertanding dilihat menyalahgunakan harta rakyat terutama kenderaan milik kerajaan Persekutuan, Negeri dan Tempatan. Manakala UMNO-BN memonopoli dewan orang ramai, sekolah, KEMAS dan JKKK sebagai markas parti.
Amalan ini adalah satu kesalahan besar kerana seharusnya harta milik kementerian, kerajaan negeri dan pihak berkuasa tempatan tidak boleh digunakan bagi parti-parti politik yang bertanding semasa berkempen dalam pilihanraya.
Untuk memastikan pilihanraya akan datang adil kepada semua pihak yang bertanding, NIEI mencadangkan agar politik wang, janji peruntukan projek, projek kilat, salahguna jentera negara dan salahguna kemudahan awam hendaklah dihapuskan.
Di negara-negara jiran, terutamanya Thailand, Nepal dan Taiwan amalan ini diharamkan. Kesalahan bersabit dengannya akan diambil tindakan keras, iaitu SPR-nya akan membatalkan calon bersalah daripada bertanding, atau dibatalkan kemenangan mereka.
Untuk menghapuskan amalan ini, undang-undang anti rasuah politik dan penyalahgunaan harta awam hendaklah digubal seperti yang dilaksanakan di Thailand dan Taiwan.

3. Perayu undi, tukang sorak dan pengangkutan yang disediakan oleh parti politik pada hari mengundi


Amalan merayu undi dan tukang sorak telah menyebabkan ketegangan berlaku pada hari mengundi. Apabila perayu-perayu undi dari kedua-dua parti politik bersaing untuk merayu undi berhampiran dengan tempat pembuangan undi, ianya menggangu pengundi-pengundi untuk melaksanakan tanggungjawab mereka.
Selain daripada itu kemudahan pengangkutan yang disediakan oleh parti politik untuk mengangkut pengundi turut menyesakkan keadaan di hadapan tempat pembuangan undi yang biasanya dilaksanakan di sekolah.
Bagi memastikan pengundi-pengundi dapat berfikir dengan tenang sebelum masuk ke tempat pembuangan undi, NIEI menyarankan agar amalan merayu undi, tukang sorak dan penyediaan kemudahan pengangkutan untuk mengangkut pengundi dihapuskan.
Sebagai ganti, tempoh berkempen bolehlah diperpanjang seperti dua minggu bagi pilihanraya kecil dan sebulan bagi pilihanraya umum. Parti-parti politik bukan kerajaan yang sering tidak mendapat tempat di media arus perdana aktif berkempen pada hari mengundi oleh kerana tidak mendapat liputan yang adil oleh media arus perdana dan tempoh berkempen yang singkat, jika tempoh berkempen diperpanjangkan, semua pihak akan mendapat masa yang cukup untuk berkempen.
Selain daripada itu, SPR bolehlah menyediakan kenderaan untuk mengangkut pengundi seperti van, kereta dan motosikal sebagai alternatif kepada kenderaan-kenderaan yang disediakan oleh parti politik.

4. Perbelanjaan berkempen


Dalam PRK Bagan Pinang, dapat disimpulkan bahawa perbelanjaan yang digunakan untuk berkempen bagi calon BN, Isa Samad telahpun melebihi had yang ditetapkan iaitu RM 100,000 bagi calon DUN.
Menurut Seksyen 19(1) (a) dan (b) Akta Kesalahan Pilihan Raya 1954, calon-calon yang bertanding dalam pilihan raya umum hendaklah berbelanja tidak melebihi had yang ditetapkan iaitu untuk calon Parlimen RM200,000 dan calon DUN RM100,000.
Akta ini harus digubal semula dan harus menyatakan bahawa ianya termasuklah kepada parti politik yang menyokong sesuatu calon tersebut. Kerjasama dengan Suruhanjaya Pencegahan Rasuah Malaysia (MACC) bolehlah dilakukan untuk memperketatkan lagi pemantauan perbelanjaan kempen.

NIEI berharap agar isu-isu yang dibangkitan akan diambil perhatian serius oleh SPR agar perjalanan pilihanraya di Malaysia dapat menjadi lebih baik pada masa akan datang. Semua parti politik yang bertanding diseru agar bekerjasama bagi memastikan proses perjalanan pilihanraya di Malaysia menjadi lebih adil, telus dan saksama. Pilihanraya yang berkredibiliti akan meyakinkan lagi rakyat dengan amalan demokrasi di Malaysia.

A Mystery Letter In Teoh Beng Hock Inquest-May Also Happened in Sarawak

The letter that surfaced during the Inquiry on the death of Teoh Beng Hock did not surprise me because of what happened in Sarawak. In Selangor, its Deputy Director (DD) , PKPj I Hishamuddin Bin Hashim has been implicated in a letter , suspected send by MACC Officers from Selangor. In the letter, amongst others it said that Hishamuddin Bin Hashim has been collarborated with ex-Selangor MB Dr Khir Toyo(l) to topple PKR government in Selangor, and to stop MACC investigation on Khir Toyo(l) corruption cases. Could there be any collarboration between Sarawak CM with local MACC officers or head? Respectfully, we would like to refer to the matter above. We, officers in MACC, feel duty bound to expose the wrongdoing and corrupt practices by a senior officer of MACC – Deputy Director (DD) of MACC Selangor, PKPj I Hishamuddin Bin Hashim. He is related to the cases of Teoh Beng Hock and bungalow house at Section 17, Shah Alam, owned by Dato’ Seri Dr Mohamad Khir Bin Toyo. 2. For the information of YBhg Tan Sri/Dato/Tuan/Puan, DD is indeed involved directly with the investigation of misappropriation cases involving Selangor exco YB Ean (Adun Seri Kembangan). DD’s involvement is not only at the level of official instruction, but he actually instructed specifically MACC officers to try to uncover any possible wrongdoings by the current Selangor state government. He acted so because of his collaboration with Khir Toyo to bring down the Selangor state government. Due to his overzealous approach, hence the death of Teoh Beng Hock. There are a few questions arising from the circumstances of Teoh Beng Hock’s death that concern us MACC officers. We all suspect DD to be responsible for the death of Teoh Beng Hock based on the following facts: i) DD has instructed all MACC officers involved in the operation not to implicate his direct involvement in the case. In fact, he is the one giving direct orders in the operation and other operations in MACC Selangor. Actually he fears his involvement will compromise his collaboration with Khir Toyo. ii) The chemistry department has detected finger prints and DNA traces of a mysterious male at the two frontal sides of Teoh Beng Hock’s waist belt. According to our knowledge, DD has his unique interrogation technique, i.e. he would hold the belt of the person under interrogation, lift him/her a few times and shake him/her. iii) The process to extract DNA samples from MACC Selangor officers was conducted in two sessions. In the first session, DD ran away to avoid having his sample taken. However, DD was said to have given his DNA sample in the second session under dubious circumstances, i.e. he gave his sample in his room while all other MACC officers, including the MACC Director, gave their samples in the meeting room together openly. Why did DD give his DNS sample hidden in his room? Is the sample given by him indeed belong to him? We the MACC officers are curious because none of the DNA samples collected matches that of the mysterious male. We suggest that DNA sample of DD be taken again under the watch by trusted people. iv) We have gotten information that DD has instructed his subordinates to erase fingerprints found at the window where Teoh fell to his death. This is proven as the police has failed to find any traces of fingerprints new or old at that window. The question is, why did DD give that instruction? v) Based on the information we obtained, we suspect DD did not punch out when he left office on 16 July 2009 at 6.10am. This is cricial because it would be evidence that DD was the last person to have seen Teoh. The question is, why did you not punch out when he usually does so? For the record, he is a person paying attention to his punch card. 3. For the information of YBhg Tan Sri/Dato/Tuan/Puan, DD is very influential in the investigation operations in Selangor, or even the whole Malaysia. In MACC Selangor alone, he is the most important person to decide whether or not a case is to be prosecuted, even though such power is supposed to be in the hand of the Deputy Public Prosecutor (DPP). Decisions made by him favour his own interests or his cronies’. It is no surprise that he has been helming the investigation unit of ACA/MACC Selangor for more than ten years, i.e. since the Selangor state government under Barisan Nasional (Khir Toyo) and until the current Selangor state government. He has been promoted in quick succession from Grade 41 to Grade 54 within 16 years without reassignment and remained in MACC Selangor until now. According to ACA/MACC department policy, an officer who has been promoted or served for more than 5 years in a state will be reassigned to another location to avoid him from being involved in local corruption problem. One of the reasons that he has not been reassigned elsewhere is that he has been tasked to “take care” of interests of Dato’s Seri Khir Toyo in Selangor. Because of this, to reciprocate, Khir Toyo has to “take care” of DD’s interests in Selangor. 4. Due to his comfortable position in ACA/MACC Selangor from then till now, he has been involved with various corrupt acts and abuse of power. Among the corrupt acts and abuse of power by DD that we have detected/investigated are as follows: i) Closing the case of Khir Toyo involving approval of a road construction project, which is the most expensive, spanning bendang at Sekinchan, for a distance of 20.5km, at a price of RM92.5 million to the contractor who was almost blacklisted – Meram Holdings. According to JKR assessment, the cost of the road should not exceed RM50 million. The subcontractor running the project is Cabaran Wangsa, owned by Pua Kim An, who was once the landlord of Khir, while the other director of the company, Ahmad Tarmizi Tajjeury, is Khir’s crony, and he got 100 acres of land giving him a profit of RM20 million. ii) In possession of assets beyond his means, including: a. Owns a few houses for rental, including one two-storey luxurious terrace house which was purchased at a very attractive price from Pemaju Kumpulan Lebar Daun Development Sdn Bhd, as a result of closing the case of investigation against Group Executive Chairman, Dato’s Noor Azman @ Noor Hizam bin Mohd Nurdin. The case was investigated by ACA Selangor a few years ago and he owned a few more houses. As a smokescreen to the public and his subordinates, he has been living in the government quarters at Kg. Atap, Kuala Lumpur. b. Owns a Petronas petrol station located at the left side of Federal Highway at Km 8.6 – Km 8.7, Section 1, Federal Highway, Shah Alam 40000 Selangor (near the Melati roundabout, in the direction of Klang from Shah Alam), registered under the name of his elder brother. The petrol station has just started operation this year (2009), and it is built on part of the land of a Chinese cemetery. He managed to obtain the land to build the petrol station as a result of his power as well as due to the Khir Toyo administration in Selangor. c. Owns a few plots of land around Shah Alam, where one of them is believed to be beside the new SACC Mall, registered under the name of the wife of a driver in MACC Selangor, Abdullah b Azim, she being a full time housewife in her late 30s. iii) Caught in adultery with a junior officer of the rank of Investigator called Nor Azlina bt Mustafa at the lake side of Shah Alam Lake in early 2009 by two police officers. He in turn showed his authority card and informed the police officers that he and the Investigator were in an operation and hence let off by the police. After a few intimate incidents with the Investigator, the affair is known by many, including his wife. The action taken by the department is to reassign the Investigator to MACC HQ at Putrajaya. This action is not effective as Azlina is still seen with DD at the Selangor office. 5. This letter was writen to uphold integrity and challenge injustice, in the MACC specifically and Malaysia as a whole. We at the MACC can no longer stand to observe this behaviour which is approved by higher-ups. We at the MACC have exhausted our options in looking for a department/institution/NGO which can bring forward this issue so that appropriate action can be taken. 6. We the officers in MACC are greatly appreciative and thankful to you all for bringing up this matter to the people and the relevant authorities so that there will be an organisation/NGO that can take the appropriate action or independent investigation until the matter can be brought to the cabinet. The matter is very important because it involves the integrity of an officer serving in a department charged with enforcing law on crimes related to human integrity. DD is now working very hard by instructing his subordinates to do witch hunt on PKR which governs Selangor state now, with the hope that PKR will fall in Selangor and his secrets will be safe. For your information, DD is fearful whenever news of Dato’ Seri Khir Toyo appears in the media and he is fearful that if Khir’s case will expose his own case. 7. Our hope is, there will be party which is courageous to voice out our information here so that our action attracts the attention of authority and just action can be taken against him and put him to justice. We ourselves are not capable of taking action against him because he has “cable” (connection) to the top. 8. Cooperation from YBhg Tan Sri/Dato/Tuan/Puan is very much appreciated and hopefully your action will bring out more information exposing people without integrity so that MACC and its officers are clear of corruption. Arrest of A BN Assemblymen From Trengganu by MACC - An Attempt to pacify the public And as A Scape Goat For BN Bigger Fishes

Malaysian Anti-Corruption Commission (MACC) investigations director Datuk Shukri Abdull said that the arrests of State assemblyman for Kemasik, Rosli Othman, and his aide Ramli Abdullah should not be politicised.
“It has nothing to do with any other case. It is totally a separate issue
and I hope this will not be politicised.”

Teoh was found dead after being questioned by Selangor MACC officers in connection with investigations into complaints of mismanagement of funds for several constituencies in the State. While the cause of his death is now the subject of a coroner’s inquest, his demise had brought about a wave of scathing attacks against the MACC. On the day of Teoh’s death, for example, DAP secretary-general Lim Guan Eng had launched a stinging rebuke of MACC, calling for the agency to stop its “political persecution” of Pakatan Rakyat, especially DAP leaders and members. His father, DAP national chairman Lim Kit Siang, had also called on Prime Minister Datuk Seri Najib Razak to “stop the MACC war against Pakatan Rakyat and direct it to return to its original purpose of declaring war against corruption”. Following this, it had been revealed that the MACC had questioned more than 20 BN politicians and less than five from Pakatan this year alone. While the MACC has charged several BN politicians, the most prominent recently being Federal Territory Umno Youth chief Datuk Mohamed Norza Zakaria, who pleaded not guilty to two corruption charges involving alleged vote-buying in the run-up to the Umno general election. No politician from the Pakatan Rakyat coalition has been charged yet. Shukri said Rosli and Ramli are expected to be produced before a magistrate’s court today in Kemaman, Terengganu, to be remanded for investigations to commence on a claim that a contractor had paid a RM20,000 bribe as inducement to secure a landscape project in Kuala Lumpur for one Cekal Sekitar Sdn Bhd. It was learnt that Rosli was picked up at about 9.30am at a hotel in Kemaman, a quiet town south of Kuala Terengganu, with another man. Malay Mail also learnt that MACC officers had found RM5,000 on him. A source said the two were detained at the Kemaman police station and would be produced in court today. The MACC is applying for a five-day remand order to detain them to facilitate investigations. Other than an assemblyman, Rosli, 42, an engineer by profession, also holds the deputy chairman post of the State Local Government and Housing Committee. A graduate of the University of Middlesex in London, the Bukit Kukuran Umno branch chairman beat Pas’ Mohamad Mahadi Nawi in the 2008 polls by over 2,000 votes MACC is directly report to PM Najib. Every action taken, PM Najib must be fully awared about it, and for me they are the Barisan Nasional Dog. Thus whoseever BN Assemblyman being arrest for questionning subsequently wether charge and court or freed without being charges, will be just a scape goat for bigger fish in Barisan Nasional.

Just look at Taib Mahmud, despite so many articles had been written about his corruption practices by the bloggers and the newspaper, but until now he is still a freeman and still making more monies from the state development Project. Look what happen to Tan Sri Khalid as comparison with Khir Toyol?
