Another Religious Supression By Muslim against Christians in Malaysia

Agroup of Orang Asli Christians here today lost a two-year court battle against local and state authorities, seeking basic amenities at their village church.
The High Court here struck out the 2007 suit by a group of Jahut Christians from Kampung Pasu against the Temerloh Land and District Office and the Pahang state government for disconnecting power and water supplies to their village church in Kampung Pasu here.
“The application for a judicial review was dismissed with cost,” Pahang state legal adviser Kamal Azira told The Malaysian Insider.
The amount for cost will be determined by the court later, he said.
Kamal, who was acting for the state and local authorities, said the judge, Datuk Akhtar Tahir, had only given a summary decision in chambers and will supply the written grounds of judgment later.
The government lawyer added that the judge also made a brief reference to Sections 6 and 7 of the Aboriginal Peoples Act 1954, which supposedly gives the state authorities the power to gazette an area as “Aboriginal Land.”
Pressed to explain the implication of the court ruling, Kamal, who asked not to be photographed, repeated that the law says “the state authorities are the ones to gazette if an area is [an] Orang Asli area.”
Lawyers for the Jahut Christians told The Malaysian Insider they plan to file an appeal with the Court of Appeal in Putrajaya next week.

James Masing Warns UMNO and PAS to Stay Out of the Word Allah Issues

Datuk Seri Dr James Jemut Masing the Land Development Minister today became the first Iban leader/Minister that comes forward to defend the Catholic Herald in the usage of  the word Allah in it publication.
In defending the court rulings, Dr James warns UMNO and PAS not to get involve in settling the issue because according to him, they hyave the tendency to be biased and may use the issue to champion their own politic agenda,
He further added that it is only natural that UMNO and PAS will be siding muslims while the others side non-muslim, and this can mar the unity and harmony in this country.
"Please note that   the sensitivity of this issue rests on both muslims and non-muslims alike. Home Ministry should not appeal on this (case) because that would mean political interference" said Dr James when referred to UMNO and PAS in politicising the issue.

Let Religious Bodies Deal with the Issus

Masing also reminds both UMNO and PAS not to mix politics and religion but let the religious bodies or the inter-faith council to resolve the issues.
In the related issues, yesterday the Home Ministry filed an appeal against the High Court ruling that the word Allah can be used by the Catholic Herald, and today it will file an application for a stay of eexecution of the court order.
For those who knows Malaysian  Judicial system well can predict the outcome of both of the appeals!

PKR Sarawak Stands On Usage Of Word Allah By Catholic Herald

Sarawak PKR chairman Baru Bian has cautioned Sarawakians not to take religious freedom for granted as it must be nurtured and protected for it to flourish.
Speaking at a Christmas and a New Year gathering at the Blind Centre here today, he said: “This is because certain people in authority and power still impose hindrances on others by banning the use of certain terminologies and even to the extent of classifying the ‘Alkitab’ as a document prejudicial to national security under Section 22 of the Internal Security Act, which clearly amounts to an infringement of this constitutional right.
“But thank God, we do still have some right thinking people in Malaysia especially in the judiciary who are courageous and bold enough to uphold the provisions of the Federal Constitution”, Baru said.
“The recent judgment granted by the Kuala Lumpur High Court to the Catholic Church by ruling that the Home Ministry’s blanket ban on the use of word ‘Allah’ is illegal is a landmark case for Malaysia.”
High Court Judge Lau Bee Lan, in her recent judgment, stated that the home minister’s order was “illegal, null and void”, adding that the ministry also failed to substantiate any of its claims of threats to national security, which could be caused by the use of the word “Allah” by the Herald.
“We welcome this judgment as a belated Christmas present not only to the Roman Catholic Church but to all peace loving Malaysians who believe in the principles of Rule of the Law and the sanctity and the supremacy of the Federal Constitution...Baru Bian, PKR Sarawak.
Consistent with Pakatan Rakyat's stand

“This judgment is also consistent with Pakatan Rakyat’s stand on this issue. Our leader Anwar Ibrahim at our convention in Kuching on Dec 13 publicly stated in no uncertain term that non-Muslims can use the word ‘Allah’. So did Tok Guru Nik Aziz, the respected PAS spiritual adviser. months earlier,” he said.
Baru declared that there “is no place for religious extremists and religious bigots in this country, as we are a nation of varied religious beliefs and practices.”
He said religious celebrations of all faiths had always been celebrated and respected by all Malaysians before and after independence and the formation of Malaysia.
“This is because religious freedom has been guaranteed as enshrined under Article 11 of our Federal Constitution. For Sabah and Sarawak, the historical Cobbold Commission Report clearly recorded that ‘freedom to profess, practice and propagate any religion’ should be guaranteed.
“Further it was recorded that ‘Sarawak should be a secular state’. This is the reason I believe that today Sarawak remains as such without any official state religion.
“But religious freedom today cannot be taken for granted,” Baru stressed.
Attending the function organised by PKR were residents of the centre, their parents, relatives and officials from the Society for the Blind, Cheshire Home, Salvation Army and the Society for the Deaf and Dumb.

Nik Aziz: Non-Muslims can use ‘Allah’

PAS spiritual leader Datuk Nik Aziz Nik Mat has come out in support of the Catholic weekly Herald use of ‘Allah’ to describe the Christian God in the national language, saying it was permissible for those following the Abrahamic faith.
But the popular cleric expressed worry that the word “Allah” could be abused by certain quarters, echoing growing sentiment of Muslim Malaysians aghast at the Dec 31 High Court ruling that permitted its use.
“Its just a fear it can be abused. That’s the worry,” the Kelantan mentri besar said today when commenting on the landmark ruling.
Justice Datuk Lau Bee Lan said in her oral judgment that the Herald had a constitutional right to use the word, touching off a controversy that has led some Muslim groups to protest the ruling.
The government has said it will appeal against the ruling. A group has already started a Facebook group to get the government to reverse the ruling.
However, others including influential cleric and former Perlis mufti Dr Asri Zainal Abidin, have supported the ruling, saying all are encouraged to follow Allah.
Speaking to reporters after launching the state Women, Family and Health Development Secretariat, Nik Aziz said the authorities, such as scholars, should have a dialogue with the Christian clergy over the issue.
“This is so that there is no confusion among the society.
“In fact, Islamic philosophy itself can be spread through such events,” he added.
The PAS Kelantan commissioner also said he was willing to attend such events if it was organised.
However, PAS Kelantan Council of Religious Scholars chief Datuk Mohammad Daud Iraqi declined to comment on the issue.
Instead, he said it was weaknesses in the government in monitoring the issue that has led to the controversy.
“This is not a new issue, it has gone on so long. The government should have looked specifically into the laws earlier on,” he added.

Ajustice's ruling goes against the government


The decision by Malaysian High Court Justice Lau Bee Lan giving the Catholic Herald newspaper the right to use the word Allah to represent God in its Malay-language edition has been met with jubilation among the country's 850,000-odd Catholics and outrage on the part of Muslims. As many as 10,000 protesters had signed onto a Facebook group page objecting to the Dec. 31 judgment.
A flock of United Malay National Organization (UMNO) politicians have got into the act as well, including former Prime Minister Mahathir Mohamd and his son Mukhriz as well as former Selangor Chief Minister Mohamad Khir Toyo and others. Moderates including Opposition Leader Anwar Ibrahim are being called traitors to Islam for agreeing withg the decision, which is all but certain to be appealed to a higher court by the government as soon as possible and, if past practice is any gauge, a stay of execution will probably be granted.
The decision by Justice Lau, however, focuses attention on another matter entirely, and that is the growing independence of Malaysia's lower courts to issue decisions contrary to the government after nearly three decades. Her decision against the government followed another major one in May 2008 when High Court Judge Abdul Aziz Abdul Rahim ruled that Mohammad Nizar Jamaluddin, who headed the opposition in the state, was wrongly removed as the chief minister of the northern state of Perak. Najib Tun Razak, then the deputy prime minister, engineered the defection of three lawmakers from the national opposition coalition Pakatan Rakyat, bringing the government to a halt in a 28-28 tie.
In that case, Judge Abdul Aziz ruled that Perak Sultan Raja Azlan Shah did not have the power to order Nizar to vacate his position as chief minister and instead to install Zambry Abdul Kadir, a longtime Umno stalwart, in his place. An appellate court almost immediately stayed the decision. It is still being fought out in court.
In another notable case, High Court Justice Syed Ahmad Helmy Syed Ahmad in November of 2008 freed Raja Petra Kamaruddin, the editor of the internet publication Malaysia Today after the editor was ordered jailed on a series of charges, mainly in connection with a series of scathing editorials and articles that sought to link Najib to the 2006 execution murder of Mongolian translator Altantuya Shaariibuu, then 28, the jilted lover of Najib's best friend, Abdul Razak Baginda. Two of Najib's bodyguards have been convicted of the murder.
In general, according to a think-tank source in Kuala Lumpur, "Judges in High Court have been giving very independent judgments that have been overturned by the Court of Appeal. So let's wait and see whether this will happen again."
The judges, according to another source, were appointed during the six years when Abdullah Ahmad Badawi was prime minister. Badawi in 2003 succeeded Mahathir Mohamad, who had ruled as premier for 22 years and whose reign was notable for his emasculation of the country's judiciary. Lau Bee Lan was one of Badawi's appointees, in December of 2004, as was Abdul Aziz Abdul Rahim.
Although Badawi was roundly criticized for appointing Zaki Azmi, a former UMNO lawyer, as chief justice, Zaki has evolved into an effective jurist, a Kuala Lumpur source said, making strides to clean up a backlog of cases and engineering the appointment of independent judges.
"It was one of the few things [Badawi] did do right," said a Malay businessman in Kuala Lumpur. "For once - after two decades - even the Bar Council is becoming optimistic about the judiciary. But there's still a lot of rot left over from Mahathir to clean up. It's a daunting task."
Mahathir's subjugation of the judiciary began in 1988 amid an intraparty revolt against Mahathir's leadership of the United Malays National Organisation, when a Malaysian high court ruled that UMNO was illegal. With the case going to the Supreme Court, now known as the Federal Court which had issued other adverse rulings against the government, Mahathir in effect fired Salleh Abbas, the Lord President, along with three other Supreme Court justices. From that time forward, there were few if any decisions that went against the government.
That ultimately blew up in late 2007 with an enormous scandal with the publication of a videotape that purported to show VK Lingam, an influential lawyer friend of Mahathir's, in conversation with Ahmad Fairuz Sheikh Abdul Halim, then the country's third-ranking judge who was in charge of most senior judges. The conversation seemed to indicate that Mahathir was closely involved in the appointment of malleable judges favorable to the then-prime minister's closest cronies, particularly gaming tycoon Vincent Tan. Syed Hamid, the Shah Alam High Court judge who ordered Raja Petra freed, was appointed to his position during the reign of one notorious Supreme Court head, Eusoff Chin, who himself was accused of a host of judicial irregularities. The Attorney General in December said Lingam was probably only bragging and declined to prosecute him.
The current case began in January of 2008 when the Malaysian cabinet reinstituted the cancellation of the Roman Catholic newspaper's publishing license for using the word "Allah" interchangeably with "God" in its Malay language section. The Herald, which prints in English, Bahasa Malaysia, Tamil and Chinese, was first notified that it would no longer be allowed to use the word "Allah" on October 18 and November 1, 2007. But after informing the publication of the decision, a representative from the Internal Security Ministry later delivered a letter with the permit to print without restrictions, the publication's editor, Father Lawrence Andrew, told the media at the time.
The permit was withdrawn, however, a week later, when the ministry approved the paper's publication permit only on condition that the word "Allah" be prohibited and that the paper only be circulated to Christians. The church responded that the Malay-language edition of the paper is mostly read by tribes who converted to Catholicism or other Christian faiths, the preponderance of them in the East Malaysia states of Sabah and Sarawak, and that no other word would suffice to describe the deity.
Numerous religious scholars have pointed out that since Christians, Muslims and Jews worship the same god, calling the deity "God" in English means exactly the same thing as calling him "Allah" or "Yahweh" in other languages.
The issue has become intensely political, however, with Malaysia's increasingly assertive fundamentalist Muslims concerned that the Christians are proselytizing Malays in an effort to lure them away from Islam.
In her decision, Justice Lau, however, said the federal constitution allows the church to use "Allah" in the Herald as an exercise of its right to practice religions other than Islam. The constitution, she ruled in an oral opinion, gives the church "the right to use the word 'Allah' in the Herald in the exercise of his right to freedom of speech and expression."
Critics have charged that Justice Lau is a Christian, which influenced her decision. One website stated that she takes at least 15 days per year to teach Bible studies throughout the country. Others have pointed out that if the case had been passed to a Muslim judge, the chance for influence was as great if not greater.

No mention of meetings with State Department, on Capitol Hill, with the White House, or any think tanks. Instead he bragged about 1Malaysia to the choir of Malaysians who have already heard it so many times. He also offered some comments on Malaysia's economy, which according to a recent report is failing to make much progress these days.
No media in US would want to interview him and also no one in US would like to be seen with him.Also at the same time India's Manmohan Singh was in the US and what did Barak Obama do? He went out of his way to charm both Mr. and Mrs. Manmohan Singh in a White House black-tie state dinner.He didn't even notice Najis's presence in the US.Tell me if not the Mongolian girl then what is it that merits being ostracized in the States for Najis? However Barak Obama has placed great respect for the Minister Mentor of that tiny red dot to invite him to the White House in late October for a tete-a-tete with him so that he can pick Harry's brains on what his thoughts are of a changing world and America's role in it.And LKY is no longer the PM of Singapore!....Recieved Through Email
What is the point of a 20 million dollar contract with APCO if our prime minister cannot even get a manufactured speaking slot at the National Press Club? We're not even talking about Brookings or SAIS where one has to have something meaningful to say to be invited. Anyone can speak at the Press Club so long as they can afford the cost of organising the function. Does the concept of 1World not carry much weight in the halls of international diplomacy or in the most powerful city in the world? I guess not.
I think taxpayers should demand to know why, after spending that much money on a DC lobby our prime minister cannot even get an interview on the local news.
On Anwar Ibrahim's recent trip to the United States, in just a few days he held events at Brookings, SAIS (even our US Ambassador attended the function),Georgetown and the Council on Foreign Relations. He met with officials from the House foreign relations committee, the Senate Foreign relations committee, the state department and the White House. His visit covered in the media including the Wall Street Journal, Far Eastern Economic Review and theWashington Post (but not Bernama), Saudi television and ABS-CBN from Manila.
Does the Prime Minister's flimsy schedule have anything to do with the scandal that just won't go away? Not PKFZ. Not the Bukit Antarabangsa slide. Not the collapsed bridge. None other than the Mongolian who we cannot talk about. And in the time it took me to write this, how many new designer bags did the Prime Minister's wife purchase?

Danish police late Friday shot and wounded a man close to radical Somali Islamists who tried to enter the Aarhus home of Kurt Westergaard, who drew controversial cartoons of Islam's prophet Mohammed, Danish security sources said.
The Danish cartoonist, who has received several death threats since a Danish newspaper four years ago published his drawing featuring Mohammed wearing a turban in the shape of a bomb, was at home in Viby near the western city of Aarhus when the 27-year-old and two others tried to get in, daily Politiken reported online.
Guards repulsed the three intruders as security alarms were set off, and the wounded man was hospitalised.
Denmark's Ritzau news agency said a dozen police vehicles were at the scene while sappers were sent in to look for a bomb that might have been laid.

Police tightlipped

Contacted by AFP, Jutland police confirmed an incident near the home of the 74-year-old cartoonist but refused to give details pending the release of a statement later.
Westergaard is one of 12 cartoonists whose drawings of the Muslim prophet were first published in Danish newspaper Jyllands-Posten in September 2005, sparking controversy among Muslims worldwide.
The 12 cartoons were considered offensive by many Muslims and their publication sparked violent protests worldwide in January and February 2006.
Demonstrators burned Danish flags in protests that culminated in February 2006 with the torching of Danish diplomatic offices in Damascus and Beirut and dozens of deaths in Nigeria, Libya and Pakistan. - AFP

Perak Mufti Should Slam The Terrorist Acts By Its Fellow Muslim


The mufti who immune From Police Action

Among all the muftis in Malaysia, the mufti of perak is the most controversal and the most unfriendly mufti toward the followers of other faiths. In October 2006, he forwarded the most controversal SMS by claiming that Datuk Azhar Mansor was going to convert 250 muslims to christianity in one of the church in Ipoh. His SMS nearly caused religious unrest in Ipoh whereby hundreds of muslims sorrounded the said church. But no actions were taken by the police against the Perak's mufti.
Being the Mufti who is paid with tax payer monies from the muslim communities and people of the other faiths, his responsibilities should also include to maintain the peaceful environment between muslims and non-muslims in Malaysia. Please avoid this country from becoming another Afganistan or Pakistan by Stopping  your controversal approach!...Bukittunggal
And on 1st January 2009, he was among many muslims that against the high court decision in the usage of word Allah by Catholic Herald.He accused the judge/court did not respect the feeling of the Muslims.
I urge all catholics in Malaysia to make police report agains this mufti for contempt of court. As for the police they should take pro-active action, and  without waiting for the police report. Surprisingly despite so many controversies being made by this mufti, but the state of Perak still retain him and no action by the police.
Being the member of PAKATAN RAKYAT myself, I urge all the muslim clerics/schoolars in PAKATAN RAKYAT to come forward and condemn this racist mufti.

Special New Year Greetings From Barisan Nasional Government

This year Malaysians will need to spent extra monies from their incomes , as Barisan Nasional government had announced the increase on price of certain items in 2010. The items which prices had been increased with effect from 1st January 2010 are :-

  1.  Sugar. The price of sugar has been increased for 20 sens per kilogram. Before the increase, the price of sugar in Peninsular per kilogram was at RM 1.45 and RM 1.55 in Sabah and Sarawak. According to the Domestic Trade, Cooperatives and Consumerism Ministry secretary-general Datuk Mohd Zain Mohd Dom, who made the announcement, said the increase in the sugar price was necessitated by the rise in the price of raw sugar in the world market, and that the government still subsidised the price at 80 sen per kg or RM1.008 billion for the year.
  2. White Bread. The government also announced that it withdrew its subsidy on white bread and removed the commodity from the price control scheme.
  3. Cigarette Minimum Price Regulation. With effect from 1st January 2010, the smokers will need to pay more on their cigarettes as BN government had came up with the minimum price for cigarettes regulation.With this regulation, a minimum price for 20s cigarette will be sold at RM 6.20.
  4. Credit Card Service Tax. Card holders will need to pay RM50 credit card service tax on all principal credit card and RM25 for every supplementary card. The tax according to BN government was to discourage unwise spending by card users.
  5. Government decision to increase the price of sugar, white bread and cigarettes, and the introduction  of Credit Card Service Tax will have serious consequences on the public especially the lower income group.
Plights by some Iban in the Longhouse  

My recent visit to Kampong Empaling and Kampong Tekuyong, both are under P202 and N25, when told about the price increase on certain items that affect them such as  the price of sugar and cigarettes, most of them were not happy with the government.
According to them, in 2008 when the government increased the price of petrol, most of  the price of  the items were shoot-up. The effort by the government to reduce the  price  of petrol in the same year did not help much as its did not bring down the price of  the items.
Their village heads, TR Ngulu and TR Jawan also informed Bukittunggal that most of the subsidies promised by BN government such as the subsidies for petrol and diesel for their generators,  and the rice subsidy until now has not reached them. They added with the new price increases announced by the government it will affect the life of people in the longhouses badly.

My Advice To the Voters in the Longhouses.

PM Najib slogan "“1Malaysia. People First. Performance Now” " is just a rethoric. So far,  he and BN government have done nothing in helping the people.
Enough is Enough. The people of the longhouses must supports the PAKATAN RAKYAT in the coming State Election.

Breaking News-Augustine Paul Passes Away

KUALA LUMPUR
2nd January 2010



Federal Court judge Datuk Seri S. Augustine Paul, who shot to prominence for presiding over Datuk Seri Anwar Ibrahim’s 1998 corruption case, has died today of an undisclosed ailment. He was 64.
It is not known what caused his death but he had been bed-ridden for some time. It is understood the funeral will be held tomorrow.
Paul was first appointed as a judicial commissioner on Sep 1, 1996 before he was elevated to the High Court on May 15, 1998.
He presided over Anwar’s sodomy and corruption trials where his remark “irrelevant, irrelevant” was the most quotable quote from the proceedings.
He was made a Courts of Appeal judge on Aug 1, 2003, and later joined the Federal Court bench on June 17, 2005.
