Najib 1Malaysia, the concept that aims to unite Malaysian multi-racial, really showed it real colour when it denied Nicholas Mujah, a representative from Sarawak Dayak Iban Association (SADIA)from attending it forum held in Pullman hotel here last Thursday.

Jaringan Orang Asal SeMalaysia (JOAS) strongly condemns the discriminating act by the Prime Minister’s Department in dispelling a community representative from participating in the public forum that was organised by the department that aims to gather information and feedbacks on numerous issues so as to understand and resolve the perennial problems of the people.

Nicholas Mujah, a representative of the Sarawak Dayak Iban Association (SADIA) was asked to leave the forum for no apparent reason by the organisers.

The Sarawak Lab, part of the national circuit, was held on 9 February 2010, at Pullman Hotel Kuching and was chaired by Idris Jala.

I attended the opening of the GTP by CM Taib at Borneo Convention Centre on 15th January 2010. In his  introductory speech on Government Transformation Program (GTP),  Idris Jala invited all Malaysians to give input to Pemandu for the success of  1Malaysian concept. If what written here is correct, meaning Idris Jala and the rest of his team are liars, 1Malaysia is moving towards doom! Dispelling Nicholas Mujah is not only insulting the organisations that he represented but also an insult to the Iban...Bukittunggal

The Participants include senior government officers consisting of officers from various ministries, Resident and District Officers and the Sarawak Attorney General. Various plantation companies were also present as well as community chiefs and a few individuals who were interested in the public forum. Participants took part in three discussion labs; socio economic, native customary rights (NCR) and the Native Court. 

One of the feedbacks from the NCR group was given by Hassan Sui who addressed the disputes caused by the lack of accountability and transparency of government agencies such as the Land and Survey Department as well as plantation companies such as Pelita, and shared his recommendations. Another feedback by Temenggong Stephen Jussem stated that the ongoing manipulation and intimidation against the Tuai Rumahs to certify native land and boundaries, should stop.

Mujah had already participated for the first part of the forum in the morning session. During the morning tea break, he was pulled by one of the organisers to a room and was told to leave the forum as the event is only for invited participants and government officials. 

Mujah protested that the forum is for the public and continued to insist that he should be in the forum. However, the organisers later told Mujah that the directive to eject him out of the forum came from the top.

The organisers of the forum were wrong in ejecting Mujah out. Mujah, a well-known community representative and NCR activist, in advocating Orang Asal rights plays an important role in providing feedback as well as recommendations for this public forum. He should not be stopped from attending the forum, unless the Prime Minister’s Department is not serious in addressing this issue and this event is just another window dressing for the public.

JOAS questions the accountability of the public forum that does not include the participation of a community representative and organisers that lacks of responsibility to be inclusive of all rakyat so as to ensure a transparent and open public forum to discuss upon the most important issues that are faced by the indigenous peoples of Sarawak today.

Until the government moves forward towards a meaningful solution with the full and effective participation and the free, prior and informed consent of the Orang Asal as enshrined in the United Nations Declaration on the Rights of the Indigenous Peoples (UNDRIP), NCR land disputes will continue to take place throughout the state, to the detriment of the rights of the indigenous peoples of Sarawak, the sustainable development of the Sarawakian population and the image of the state of Sarawak and Malaysia, contrary to the spirit of 1Malaysia.

Najib Must Respond to the Report By Political and Economic Risk Consultancy (PERC)

Lim Kit Siang said today that Prime Minister Datuk Seri Najib Razak must respond to a damaging report by an international risk consultancy which said that Malaysia was veering towards instability.

The Hong Kong-based Political and Economic Risk Consultancy (PERC) report noted that Najib’s administration is steering the nation towards instability.

PERC also said that Najib’s strategy of “trying to be all things to all people” through his supposedly all-encompassing 1 Malaysia concept is likely to “satisfy no one”.

“(So) what is Najib’s response to PERC’s report and the prospect of Malaysia becoming even more uncompetitive internationally because of his failing strategy to be all things to all people?” asked Lim today.

The Ipoh Timur MP then highlighted parts of the report including PERC raising Malaysia’s risk index from 5.24 in December to 5.4 in January — out of a possible maximum score 10 for highest level of risk.

PERC also asserted that a group of elite minorities were dominating the national agenda to the extent that it was hurting Malaysia’s attractiveness to investors.

It noted that foreign investments into Malaysia have not been forthcoming, either in direct form or in the equity markets.

The consultancy said this was due to the “probable” fact that no other Asian country is suffering from as much bad press as Malaysia.

Among the developments that caught its attention were the theft of military jet engines, detention of terror suspects from a number of African and Middle East countries following warnings that Islamic militants were planning attacks on foreigners at resorts in Sabah.

It also pointed to renewed ethnic and religious “violence” that included arson at some churches and mosque desecrations, and the questionable integrity of key institutions like the judicial system in the sodomy trial of opposition leader Datuk Seri Anwar Ibrahim.

“Foreign companies and investors are remaining cautious until they see how Malaysia gets its own house in order,” said the report.

Lim said PERC has also been critical of Najib’s premiership and this has reaffirmed his earlier criticism that the latter’s 1 Malaysia concept is “wishy-washy” and littered with double standards.

The former opposition leader also said yesterday’s Federal Court verdict that upheld BN as the rightful Perak government will also hurt the country’s competitiveness.

“It legitimises Najib’s Barisan Nasional coup d’état government in Perak,” said Lim, arguing that this would affect public confidence in the judiciary.

Malaysia is Moving Toward Monarchy With Absolute Power says Zaid

Former de facto Law Minister Datuk Zaid Ibrahim described the Federal Court’s ruling favouring the Barisan Nasional-led (BN) Perak government as an embarrassment.

“It’s warped legal reasoning. Like I said before these people for political expediency have abandoned legal principles,” Zaid told The Malaysian Insider.

In a 5-0 ruling, the Federal Court earlier today declared Datuk Seri Zambry Abd Kadir as the legitimate Perak mentri besar, ending the Pakatan Rakyat (PR) attempt to regain control of the state which it lost about one year ago.

The five-man panel of judges, comprising Court of Appeal president Tan Sri Alauddin Mohd Sheriff, Chief Judge of Malaya Tan Sri Arifin Zakaria and Justices Datuk Zulkefli Ahmad Makinuddin, Datuk Mohd Ghazali Mohd Yusoff and Datuk Abdull Hamid Embong, also ruled that a vote in the state assembly was not necessary to determine whether ousted Mentri Besar Datuk Seri Nizar Jamaluddin still enjoyed the support of the majority of the state lawmakers.

“BN leaders must be aware that the ruling in Nizar’s case has legitimised the monarchs’ power to dismiss a lawfully-elected mentri besar. Already he has the power to appoint anyone he chooses although not accepted by the party with the bigger majority as in Terengganu. Now he can also dismiss. So what democracy is left?,” said Zaid, referring to the appointment of Datuk Ahmad Said as the Terengganu mentri besar in 2008 despite the opposition from the majority of the Barisan Nasional state lawmakers.

The PKR supreme council member also promised that PR would restore the independence of the judiciary should the coalition comes to power.

Previously, Zaid (picture) had said that the Perak case was key to restore public confidence in the judiciary.

The state political crisis started one year ago when four PR assemblymen declared their support for BN, giving it a three-seat majority in the 59-member assembly.

Nizar later advised the Perak Sultan to dissolve the state assembly to pave the way for state elections but the monarch asked for the PAS man’s resignation and subsequently installed a BN-led government.

Nizar then mounted a legal challenge to Zambry’s appointment and won at the High Court, which noted that there was a loophole in the Perak Constitution to allow for another to be sworn in as mentri besar when the incumbent had not resigned.

In his decision on May 9 last year, High Court judge Abdul Aziz Rahim ruled that the Sultan was not constitutionally empowered to sack the MB, and that Nizar had always been the lawful head of the state government.

But the decision was overturned by the Court of Appeal later that month.

Zambry is the lawful MB, Federal Court agrees

High Court  decided he is no a legitimate MB but court of  Appeal and Federal Court recognised this man as a legitmate MB.....But the majority of the rakyat agree with the High court judge!

The Federal Court today agreed with the Court of Appeal and ruled that Barisan Nasional's Datuk Seri Zambry Abd Kadir (above) is the lawful Mentri Besar of Perak. This snuffs out the last hope of his toppled political rival and predecessor Datuk Seri Nizar Jamaluddin to be reinstated to the position.

The five-man panel of judges comprised Court of Appeal president Tan Sri Alauddin Mohd Sheriff, Chief Judge of Malaya Tan Sri Arifin Zakaria and Justices Datuk Zulkefli Ahmad Makinuddin, Datuk Mohd Ghazali Mohd Yusoff, and Datuk Abdull Hamid Embong.

The judgement was read out in court by Tan Sri Arifin Zakaria. “There is no requirement in the State Constitution which requires a vote of no confidence to be taken in the State Assembly. In the present case, there is no doubt that Zambry has the support of 31 of the 59 members of the state assembly,” said Tan Sri Arifin Zakaria.

Attorney-General Tan Sri Abdul Gani Patail later told reporters, "It's a very clear judgment with very, very sound reasonings. There's no doubt about it. What has been done was to reaffirm the court's decision," referring to the Court of Appeal that "Datuk Zambry is the rightful Mentri Besar."

"What the judges said is that anyone who has the majority can be appointed Mentri Besar but must prove it," added Abdul Gani, who was present when the judgement was read out.

Zambry's counsel Datuk Cecil Abraham also noted all parties are bound by the apex court's ruling.

"This decision is binding on the state government and the Federal government," he told reporters.

Nizar, 53, had challenged Zambry's appointment and won at the High Court, which noted that there was a loophole in the Perak Constitution to allow for another to be sworn in as mentri besar (MB) when the incumbent had not resigned.

In his decision on May 9 last year, High Court judge Abdul Aziz Rahim ruled that the Sultan was not constitutionally empowered to sack the MB, and that Nizar had always been the lawful head of the state government.

The judge added that the only way for the MB to be dismissed when he refused to resign was through a vote of no-confidence by his peers inside the state legislative assembly.

But the decision was overturned by the Court of Appeal later that month. The appeals court said the High Court judge's reading of the law was wrong and the latter had confused the issue of how the MB had lost the majority confidence with whether the ruler had the power to dismiss the head of government.

Nizar who is the PAS assemblyman for Pasir Panjang was chosen to head the state executive council (exco) after his Islamist party won the groundbreaking March 2008 general elections and formed an alliance with two other federal opposition groups, the secular DAP and popular pro-reform party PKR.

He was ousted 11 months later when four Pakatan Rakyat (PR) assemblymen left the fledgling alliance to swear loyalty to BN.

Bota assemblyman Datuk Nasharuddin Hashim who had earlier crossed from Umno to PKR, rejoined his old party. The assemblymen for Behrang, Jamaluddin Mohd. Radzi; Changkat Jering Osman Jailu; and Jelapang, Hee Yit Foong declared themselves as Independents friendly to the BN.

Their defections meant PR only had the support of 28 representatives in the 59-seat state assembly while the BN had 28 members plus the support of the three Independents.

The Election Commission refused to accept the three resignation letters forwarded by the pro-PR state assembly speaker which would have barred the votes of Jamaluddin, Osman and Hee from being counted.

Nizar was granted an audience with the Sultan of Perak but failed to convince the ruler to dissolve the assembly and pave the way for state-wide elections, ending what he saw as a political impasse.

Instead, the Perak sultan ordered him to resign and subsequently appointed Zambry as Nizar's replacement.

John Terry is at the centre of a sex scandal involving his allegedly affair with the former girlfriend of team-mate Wayne Bridge. The scandal not only threatening to ruin his family life but also jeopardizing his England captaincy and throwing Fabio Capello’s World Cup plans into disarray.

Terry was named on Friday as the player behind a gagging injunction involving his private life following a High Court hearing in London. The Chelsea defender had last week succeeded in securing an interim injunction against a newspaper publishing details about his alleged relationship with Vanessa Perroncel, a French-born underwear model.

But on Friday, the judge, Mr Justice Tugendhat, lifted the order, saying the information had become so widely available to so many people “it meant that an injunction was less necessary or proportionate than would otherwise be the case”.

Bridge is understood to be deeply upset by the situation, given he was a good friend of former Chelsea team-mate Terry, and Capello is considering the future of his squad dynamic, including Terry’s future as skipper, according to the British press.

Questions such as whether Bridge and Terry can be on the pitch together, or in the same squad, and whether other players would still respect Terry given his betrayal of a colleague, will now be raised.

The order, awarded during a private hearing last Friday, had covered the alleged relationship between LNS – as married Terry was referred to in court – and an unnamed woman which News Group Newspapers had wanted to publish last Sunday.

The judge suggested the claim was “essentially a business matter” for LNS and if he was worried about his sponsorship deals then “damages would be an adequate remedy if LNS succeeds at trial”. The judge also said the newspaper, the News of the World, should have been given notice about LNS’s intention to seek an injunction.

“Freedom to live as one chooses is one of the most valuable freedoms,” he said. “But so is the freedom to criticise – within the limits of the law – the conduct of other members of society as being socially harmful, or wrong.”

Terry, who is expected to captain England at the World Cup finals this summer, is married to childhood sweetheart Toni and is the father of twins.

A Chelsea spokesman told Reuters: “This is a personal matter for John Terry. The club will give John and his family all the support they need in dealing with it.”

Let God in any names it call be God

Last November the Malaysian government refused to release 10,000 Bibles it had seized because they contained the word Allah to refer to God. The Herald, a publication of the Roman Catholic Church in Malaysia, challenged the government's decision to ban for non-Muslims the use of the word Allah to refer to God. In December, a Malaysian court ruled that such a ban was unconstitutional. The court's decision provoked anger among some Muslims. The Times reported a speaker in a Kuala Lumpur mosque as saying, "We will not allow the word Allah to be inscribed in your churches. Heresy arises from words wrongly used. Allah is only for us." A few Muslims unfortunately went further and attacked churches, badly damaging some of them. Such actions are condemnable as they contradict normative Islam.

Many Muslims erroneously believe they have monopoly over the use of the word Allah, asserting that the Christian God is different from the Muslim God. And yet, normative Islam insists that there is "No God but God," meaning there cannot be a God for Christians and a different God for Muslims.

Attempts by Malaysian officials to explain the logic behind the initial ban and why the government is now opposing the high court's ruling have been far from convincing. The best analyses point out this unusual move by the ruling UNMO government had less to do with theology and more to do with the ruling political coalition keeping control. The fact that politicians were fanning the flames of passion is hardly news. But it does point to a troubling underlying fact that many Muslims erroneously believe they have monopoly over the use of the word Allah - in essence, asserting that the Christian God is different from the Muslim God. This is oxymoronic because normative Islam insists that there is no God but God, meaning there cannot be a God for Christians and a different God for Muslims.

In A Common Word Between Us and You: An Open Letter and Call from Muslim Religious Leaders, issued in October 2007 to "Leaders of Christian Churches, everywhere," acknowledges that the theologies of Christianity and Islam differ from each other on key points. Yet, when this Muslim-authored document speaks of "God", the word denotes the subject and object of Christian worship, too. This pan-Muslim call for dialogue and cooperation is predicated on the notion that the ground shared by Muslims and Christians is located in our respective scriptural mandates to love God and neighbor. Five distinguished Malaysian scholars and government officials were among the original signatories of A Common Word.

While, in the American context, we don't have legislatures reserving vocabulary for the exclusive use of one religion, we certainly have had occasions of suspicion-casting over matters of God-Talk. It finds its way regularly into political campaigns. Each of us have encountered it in venues where we have been asked to speak about Christian-Muslim relations. Both of us have had to deal with Christians who say of Muslims, "They worship a different god;" or, "there is some question as whether their god is the same as ours." Much of the internet back-and-forth about this reveals considerable ignorance (about the writer's own religion, let alone the religion she or he is criticizing).

To our way of thinking, however, discussions as to whether Christians and Muslim "worship the same God" are, even when well-articulated, based on an ill-founded premise. To ask whether another group "worship the same God as we" is to imply that there are indeed at least two gods. The technical term for such a stance is henotheism - i.e., the notion that there may be more than one god, but only one of them works for me (or, for my group). On the other hand, Muslims and Christians (and Jews, Sikhs, Bahá'ís, Zoroastrians) all claim to be monotheists; and, the logical corollary of monotheism, "belief that there is but one God", is that, no matter who is praying, only one Possibility is listening, whichever way that Ultimate Listener is named or described.

The vast majority of religions do operate from a presumption that there is an Ultimate-a single Source. Most Americans, regardless of their religion, are happy to employ the English word God when referring to this. However, each theistic religion has its own theology-its own way of describing God and God's relationship to the physical and spiritual realms. God may have many names, and concepts of the spiritual realm may be quite complex. Yet God is God; Allah is God; God is Allah. For the love of neighbor, may we be willing to affirm that - whatever language we use?

Nasir Safar Najib Special Officer make public Apology With Condition

Datuk Nasir safar, PM Majib Special Officer : " Indians came to Malaysia as beggars and Chinese especially the women came to sell their bodies”.

Despite millions of public money have been spent to promote PM Najib 1Malaysia, surprisingly there were people who still did not understand the real meaning of 1Malaysia.

On last Tuesday, 2nd February 2010 at the Malacca International Trade Centre Datuk Nasir Safar  was alleged saying a racist remarks against the Indian and Chinese communities in his speech by saying " Indians came to Malaysia as beggars and Chinese especially the women came to sell their bodies”.

As a result of his remarks, he was "forced" to resign from his job with immediate effect. And yesterday in playing down the issues, he issued a public apology with condition.

 “I would like to again openly apologise to all Malaysians for the remarks that are seen as racist. I really did not intend it that way. I have clarified that I did not intend to make racist remarks or insult any races. But there those who feel otherwise and I have apologised for any offence" said Nasir.

1Malaysia concept which has been introduced by PM Najib was one of the most noble concept by BN government. The concept is very similar to Democratic Action Party (DAP) "Malaysia Malysian Concept" , with it main aim is to unite Malaysian multi-races and religions. I am not try to sebotage the concept, but based on what happening lately, I believed that the concept will fail miserably.

The main obstacle to 1Malaysia so far came from the Malay and Muslim community. One of the Malay Association that  openly opposed to 1Malaysia concept is Pertubuhan Pribumi Perkasa Malaysia (PESAKA) which is led by Ibrahim Ali (also Pasir Mas MP who won the seat on PAS ticket) and ex-Malaysian PM Tun Mahathir.

Datuk Nasir is the latest person that "opposed" to PM Najib 1Malaysia. This really came to a surprise for me as the remarks came from a man who was supposed to translate and explain the concept to the all Malaysians!

For me, Nasir remarks representing the feelings of majority of the Malay  or people sorround PM Najib. As we all knew for the past nearly 50 years, Malay has been dominant, and due to Dasar Ekonomi Baru (DEB) or New Economic Policy (NEP) have been recieving the most benefits compared to the others. But with Najib 1malaysia concept, they will lose some of the benefits. So Nasir remarks is not a surprise for me, and please dont blame me, if I say that 1malaysia is a 'Rethoric" and one of PM Najib strategy to win back non-Malay supports.

Khir Toyo aka Toyol Scandal Revisited

Despite All the Revealetions Made Against Khir Toyo aka Toyol, so far no arrest has been made by MACC.

Khir Toyol aka Toyol abuse of Selangor State monies while in power is not something new. But what make the issues look interesting compares to other BN's CM is that the scandal involved his wife.

The scandal was reveal by SELCAT or Select Committee on Competency, Accountability and Transparency (Selcat).

Let's revisited what had been revealed by SELCAT.

AFTER a gruelling seven days, the public inquiry into possible misuse of funds by Wives of Selangor Elected Representatives Charity Organisation (BALKIS)ended yesterday, leaving those who attended reeling from the revelations. Since no one is above the law, let's monitor whether she and her husband will end-up in prison!

For more than a week, details of money spent on exotic trips, overseas souvenir- shopping expeditions and gifts for guests attending glitzy functions, kept members of the Selangor State Assembly's Select Committee on Competency, Accountability and Transparency (Selcat) riveted as the figures continued to rise.

The inquiry is the first to be conducted by a State Legislative Assembly in the country. Other States are widely expected to follow suit following the conclusion of the Balkis inquiry.

The PNSB chief executive officer Datin Khairiyah Abu Hassan dropped a bombshell when she further revealed how much the State-owned conglomerate had forked out for former Selangor Menteri Besar Datuk Seri Mohd Khir Toyo and his family's expenses during the overseas technical visits.

She also drew hoots of laughter when she explained the reasons for the trips.

Total cost: RM201,452

Dr Khir, his wife, daughter and maid also went on the trip. The purpose was for delegates to study Indonesia 's batik production, which was supposed to lead to the opening of a batik factory in Selangor.

The trip, attended by Dr Khir, his wife, children and maid as well as PNSB delegates, was to study Islamic architecture, which could be adopted in Selangor..

The group, which had a reconnaissance trip beforehand, also visited Paris Disneyland to generate ideas for a theme park in Bagan Lalang, Sepang.

They bought tickets to enter the theme park and did not meet any Disneyland representatives.

Cost of the recce team trip: RM366,000

Cost of official trip: RM416,000

Airfare: RM366,000

Ground arrangements RM420,000

City travel: RM70,000

Other expenses RM43,000

3. Honolulu (Hawaii) & Orlando (Florida) - 23 Dec 2007 to 1 Jan 2008

A technical study on the Bagan Lalang theme park was also the pivotal reason for the trip. The group, comprising Dr Khir, his family and PNSB delegates, bought tickets to DisneyWorld and again did not meet any Disneyland representatives.

Khairiyah claimed that on the trips, Dr Khir and his wife flew only first class.

Dr Khir and his wife, supposed to have been key witnesses, failed to turn up for any of the inquiry proceedings.

Dr Khir would be referred to the Committee of Privileges while Zaharah could be prosecuted under Section 5 of the Contempt of the House Act 2008. The inquiry's findings will be presented at the next sitting of the Selangor State Assembly in July.

The Malaysian Anti- Corruption Commission is expected to investigate possible criminal breach of trust (CBT) once Selcat concludes its findings and police conclude their investigations.

Anwar Sodomy Trial II -End For Najib and UMNO

Datuk Seri Anwar Ibrahim today reiterated his belief that his second sodomy trial is politically motivated.

He also claimed that Prime Minister Datuk Seri Najib Razak is the mastermind behind Mohd Saiful Bukhari Azlan’s testimony.

“Umno is ordering them (Attorney-General) to do this. Datuk Seri Najib Razak is also asking Saiful to say what is needed to strengthen the accusation and also to confuse the public,” he told reporters outside the courthouse.

Anwar’s trial finally started today after much delay and Saiful shocked the High Court today when he said the opposition leader had used profane language when asking to have sexual intercourse with him.

Saiful took the stand at the High Court as the prosecution’s first witness, testified that when he first met Anwar at a condominium in Damansara Heights in 2008, the PKR de facto leader had asked him: “Can I **** you today?”

Anwar is accused of sodomising his former aide on June 26, 2008 at a posh condominium in the exclusive Bukit Damansara suburb of Kuala Lumpur.

He has denied the charge, saying it’s a conspiracy similar to that in 1998.

The 63-year-old oppposition leader said that the fabrication of evidence against him is not new and that his lawyers are ready to expose the truth.

“This has happened before. As far as I am concerned, we have to deal with it but let my lawyers cross examine him.

“In the previous case, they claim that they were 13 spots of sperm on the mattress and said that evidence was conclusive.

“But after three months of Utusan Malaysia glorifying and campaigning with issues and tarnishing my image then they decided to expunge the record because they cannot defend the evidence. I believe this will happen again,” he said.

Same with Anwar, this Sodomy II trial is Najib and UMNO tactic to wipe Anwar Ibrahim from Malaysian Political theatre. But this trial could be the last dirty trick by UMNO because this time around I predicted that people will raise against them! 

Anwar was freed in September 2004 and later resurrected his political career by winning back his Permatang Pauh parliamentary seat in a by-election in 2008, which had been held in the interim by his wife.

He had earlier led the opposition coalition, Pakatan Rakyat, to a historic sweep of five states and 82 parliamentary seats in Election 2008.

But he was then mired with the accusation from 24-year-old Saiful, whom Anwar dismissively said was just a “coffee boy”.

Dato Seri Anwar Plans to Subpoena Premier Najib in Malaysia Sodomy Trial

Malaysian opposition leader Anwar Ibrahim said he will subpoena Prime Minister Najib Razak to testify in his sodomy trial, accusing the premier and wife Rosmah Mansour of conspiring to frame him.

Anwar’s lead counsel Karpal Singh today petitioned the court at an opening hearing in Kuala Lumpur for a delay in order to gain access to evidence. The court adjourned until 2:30 p.m. local time.

“The first thing Karpal will do is to subpoena Najib and Rosmah,” Anwar told reporters outside the courtroom. “Because they were personally involved in this conspiracy and frame-up.” A spokesman for Najib, who asked not to be identified, said it would be up to the courts to decide on the veracity of any accusations Anwar makes during the trial.

A conviction might end Anwar’s political career. The 62- year-old leader of the People’s Justice Party was jailed in 1998 on a similar charge, and barred from parliament for a decade. Najib runs the risk of being seen as using the trial for political gain, said Ibrahim Suffian, director of the Merdeka Center, an independent research institute near Kuala Lumpur.

“If Anwar loses he will be seen as a victim of political persecution; if Anwar wins, he is vindicated,” Ibrahim said. “Either way, it could just end up very badly for the government.”

Anwar’s lawyers want the chief justice to overrule the Federal Court’s decision on Jan. 29 to reject defense calls to review evidence from the prosecution before the trial begins. “Some 13 to 14 documents are necessary for the defense,” Karpal said.

Feeling the Heat

Najib is already feeling the heat from an inter-faith dispute that led to attacks on several Christian, Sikh and Muslim places of worship last month, including arson and the dumping of pigs’ heads in mosques. The government is appealing a High Court decision to allow a Catholic newspaper to use the word “Allah” to refer to God in its Malay-language section, as some Muslims feel the word is exclusive to Islam.

“This trial damages Malaysia’s already descending reputation,” said Ooi Kee Beng, an analyst at Singapore’s Institute of Southeast Asian Studies. “Burning churches, sodomy trials, severed boar heads, a ban on singular words. The Prime Minister is going to have a hard time getting foreign direct investment to flow in.”

Malaysia’s government banned non-Muslim publications from referring to “Allah” in 1986 on the grounds it could threaten national security and confuse the country’s Muslims, who make up more than 60 percent of the 27 million population. Anwar supports the use of the word by other religions.

Not Guilty Plea

The sodomy case is now in its second year after Anwar pled not guilty at an August 2008 court session to charges of having sex with a 23-year-old former aide at an apartment in Kuala Lumpur on June 26, 2008. Sodomy, defined as “carnal intercourse against the order of nature,” carries a maximum sentence of 20 years in Malaysia, even if the act is between two consenting men.

The trial and the ongoing religious dispute may distract attention from Najib’s policies aimed at boosting the economy and investor confidence in the country. Last year, the government announced measures to open up the financial and banking industries to attract more foreign investment.

In addition to 67 billion-ringgit ($20 billion) of stimulus packages unveiled last year, Najib on Jan. 28 announced a plan to reduce corruption, crime and poverty, while improving education, transport and rural infrastructure.

Southeast Asia’s third-largest economy will probably expand 4.1 percent this year after a 2.3 percent contraction in 2009, the World Bank said last week.

Anwar, a former deputy prime minister who was widely tipped to be the next leader of the country, faced similar allegations in 1998. He was sentenced to nine years in jail for sodomy and a separate corruption charge. He was released from prison in 2004 after the conviction was overturned.

Barred from politics until April 2008, Anwar won a seat in his former constituency in Permatang Pauh in August that year.
