Teoh Beng Hock Inquest Verdict : Zero Decision By Coroner

Kuching
Wednesday, 5th January 2010

The coroner returned an open verdict today in the inquest into the death of Teoh Beng Hock two years ago, a decision which means it cannot ascertain how the political aide died.

The packed courtroom broke into a collective sigh as coroner Azmil Muntapha Abas delivered his verdict while Teoh’s mother wept uncontrollably.

Azmil also ruled out suicide and homicide even though he raised doubts that Teoh could have exited unaided from the window on the 14th floor of Plaza Masalam in Shah Alam before falling to his death following overnight interrogation by Malaysian Anti-Corruption Commission (MACC) officers.

“After evaluating the evidence of Dr Shahidan, Dr Pornthip and Professor Dr Vanezis, I find that the exists sufficient evidence to confirm this injury as a pre-fall injury,” Azmil said, while reading out his verdict to the attentive courtroom.

He said he had weighed the neck injury together with witnesses who had accused the MACC of previously torturing witnesses and suspects in the course of their interrogation and then covering them up.

“However, I also find that there is no sufficient evidence to confirm beyond all reasonble doubt that this pre-fall injury did in fact, facilitate or resulted or contributed to the demise of the deceased,” the coroner added.

Earlier, he said that the likely time of Teoh’s death was approximately between 7.15am and 11.15am on July 16, 2009. This was based on testimony from pathologists.

The coroner said it was clear that Teoh died at the service corridor of the fifth floor of Plaza Masalam.

The cause of death was a result of multiple injuries sustained in his fall, he said.

The coroner also found questionable the handwriting evidence surrounding a note found by police and purportedly written by Teoh.

Despite today’s verdict, Section 339(2) of the Criminal Procedure Code provides that once an inquiry is closed, the Public Prosecutor can still direct the coroner to re-open the inquiry.

A stricken Teoh Lee Lan wipes away her tears as she emerges from the courtroom after hearing the coroner deliver an open verdict in her brother's death.

Teoh’s family has demanded a royal commission of inquiry (RCI) be set up to directly probe the circumstances surrounding the 30-year-old’s death to find out the real cause — including if he was pressured to jump.
Teoh was political secretary to Selangor state councillor, Ean Yong Hian Wah, at the time of death.

His body was found on the fifth floor of Plaza Masalam after he had been questioned overnight by the MACC at its then Selangor headquarters on the 14th floor of the same building.

The anti-graft officers were investigating a claim his boss was misusing state funds.

The police initially classified the case as sudden death; they did not rule out foul play.

A Cabinet minister triggered a public outcry when he suggested that Teoh may have committed suicide, a claim which was denounced by the latter’s family.

Teoh was to have registered his marriage with his then two-month pregnant fiancée, Soh Cher Wei, that same week.

Following the outcry, Prime Minister Datuk Seri Najib Razak met with the Teohs and Soh on July 28.

The PM assured the family “no stone will be left unturned in finding out the real cause of death and, if there is any foul play, action will definitely be taken”.

Najib said the Cabinet has agreed to set up a royal commission of inquiry (RCI) to probe further if the inquest result is not satisfactory.

Malaysian Finest, Funniest or Fuckup-est?

Kuching
Friday, 20th August 2010

Once against I would like to thank my friend from Hornbill-hornbill for sharing the posting below written by someone name KTemoc. The article was about  Teoh Beng Hock's inquest. It shown the stupidity of the MACC lawyer during the questioning of Dr Pornthip. After reading this article, I could not stop myself from doubting the qualification of the government lawyer that representing wether MACC in the inquest.
Let's read the article below.

You know, I’m just about to go to Bangkok, and I cringe to identify myself as a Malaysian because of one moron.
You want to know who he is? If you read Malaysiakini’s 'Have you ever jumped off a building?' you will initially be flabbergasted by the most inane and stupid questions you’d ever have the misfortune to hear a Malaysian prosecutor ask in court.
Then your emotions will change as you cringe in embarrassment (malu sajalah) after realizing that idiot had asked a foreigner such moronic questions.
A lawyer or An Interrogator!

The scene was at the judicial inquest where renowned Thai pathologist Dr Pornthip Rojanasunand was giving expertise evidence on the disputed cause of Teoh Beng Hock’s unexplained death after a night of interrogation by MACC ...
... mind you, Teoh was just a witness. I shudder to imagine how a suspect would have fared?
The Thing from the Swamp made a pathetic puerile attack on Dr Pornthip’s professional credential [warning: get ready to cringe in embarrassment]: "Did you know that the university that you graduated from is not recognised in Malaysia?"
Pornthip answered gently: "But it is in the top five in Asia."
Thank heavens Dr Pornthip didn’t ask: “Hey, any Malaysian university up there or close by?”
That idiot doesn’t even know that Malaysian tertiary education has become a sorry joke for the last couple of decades, yet he had the brazen effrontery to say what he disgracefully said. But then, he is a moron.
Malaysiakini reported that the Crypt Keeper “... next had the gallery groaning in disbelief when he suggested that Teoh had strangled himself and was depressive.”
When challenged by Gobind Deo, the fool actually attempted to demonstrate the art of self strangulation - wow, what a Towering Malaysian. So dont worry Tun, all's well with your concerns.
Read the following MKINI report to wonder where he crawled out from with his law degree, when he accused Dr Pornthip that: ... her report was "based on her imagination". In an effort to make his point, he asked if Pornthip has any experience jumping off a building.
Zillion of eyes must have at this moment rolled towards heaven, imploring the respective gods for salvation, from the fool.
And at this advance stage of gross imbecilic questioning by the prosecutor, Malik Imtiaz Sarwar who represented Pornthip and the Selangor government made the required rescue. He stood up to say: “With questions like these, we would all want to jump off a building.”
Indeed, and well said Malik!
But this one takes the cake – an indictment on our educational system and public service recruitment standards. The Ghoulish Goliath of Gonnawanna averred to Dr Pornthip: "If (Teoh) was unconscious, his body would be heavier."
Holy Newton, Archimedes and the Deva of Gravity! Everyone in court cringed, crumbled and cried for Malaysia.
I hope that ethnic hero Jabba the Hutt, another one called Dr DNA-Denier, the Director of BTN and Gonnabe Partial the Magician (producer of magic letter) have read or are reading what had transpired at the judicial inquest.
If they haven’t, don’t wory – it’ll be all over the Thai media, on how Dr Pornthip had to endure a marathon moronic-thon in a Malaysian court.
Now, do you know why I'll be cringing to identify myself as a Malaysian in Bangkok.

MACC Shivering as Dr Pornthip Statement Confident that Teoh's death not suicide

Kuching
Wednesday, 18th August 2010

Taken From Malaysia Chronicle

The Teoh Beng Inquest began with star witness Dr Pornthip Rojanasunand affirming her view that Beng Hock had suffered extensive injury prior to his fall and that she was sure his death was not suicide.

"I still believe it is not suicide," the Thai forensic expert told the court.

Under questioning by Malik Imtiaz Sarwar, the lawyer acting for the Selangor state government, she pointed to the injury on his neck where she said a blunt object had caused the wounds.

"Wounds caused by blunt object. Someone put something on Teoh's neck or pressed his head on something," she told the court.

She was sure it was a pre-fall injury with "more force and more weight" used than under manual strangulation. The Thai forensic expert also ruled out the possibility that the wound was caused by a fracturing of the spine upon impact with the ground.

Disagrees with Vanezis

She disagreed with the findings of MACC expert witness Dr Peter Vanezis that the mark on Teoh's neck was due to a fracture of the chin. According to Pornthip, a chin fracture area was small, while in Beng Hock's case, the hemorrhage extended to the chest. She also pointed out there are no blood vessels on the chin to cause such an amount of bleeding.

Pornthip also disagreed with Vanezis that Teoh landed on his feet or that he was conscious when he fell. She reiterated that the first autopsy report showed cerebral edema. According to her, that indicated Teoh had experienced hypoxia, where brain does not receive oxygen, for at least 5 minutes. Dr Vanezis had said Teoh was probably alive when he hit the ground.

She also said there was no fracture to Beng Hock's wrist, which was not usual in fall cases as normally a person would instinctively reach out to break the fall. She pointed to the fracture and external wound above one ankle, but none at the base of the skull, which indicates it was highly unlikely that Teoh could have landed on his feet.

However, Pornthip retracted her previous view that the anal tear and injury to Beng Hock's buttocks was caused by aggravated beatings. She agreed with Vanezis and the other 4 federal-government appointed pathologists that the injury in the anal area was caused by the fall.

Malik had begun by referring to her past testimony where she had said there was 80 percent chance of homicide gauging from pictures taken of his corpse. This time, Pornthip declined to reiterate the odds but said she was sure it was not suicide.

Pornthip also confirmed that at the second post-mortem, she did not touch Beng Hock's body. However, she was able to form her conclusion as Sungai Buloh pathologist Dr Shahidan Md Noor had dissected on her behalf based on her instructions.

Attorney-General's 'suicide' note

Under questioning by Gobind Singh Deo, the lawyer for Teoh's family, Pornthip said any notes found should be tested for DNA, fingerprints and palm prints immediately, and then be subjected to handwriting analysis.

"Protocol for a crime investigator to search for notes to find, search for it. To prove scientifically in a homicide case, DNA, handwriting can be done & tested. Crucial," Pornthip said, adding that such notes were often emotional and she preferred to rely on scientific evidence as proof of suicide.

Gobind was referring to a so-called 'suicide' note that the authorities had purportedly found in Beng Hock's sling bag in October 2009 but only earlier this month informed the court, Teoh's family and the public at large about its existence.

Malaysia's Attoney General Gani Patail has come under fire for suppressing evidence and speculation is rife the note was fabricated and produced at the 11th hour to discredit Pornthip ahead of her testimony, which is damaging for the MACC.

"I work for the rights of the dead, not the Selangor government"

Indeed, when MACC's head prosecutor Abdul Razak Musa began cross-examination, he started by tearing at her experience and academic qualifications. He tried to denigrate her professional training but a calm and composed Pornthip told him her university was among the top 5 in Asia.

"You have to understand. I work for the rights of the dead, not the Selangor government. My objective is to help the dead," said Pornthip, drawing applause from the courtroom.

Razak had suggested her testimony was biased because she had been hired by the Selangor government. He also attacked her for ruling out suicide and questioned why she insisted he was strangled when there were no witnesses. "I never said he was strangled," Pornthip told him. "I said pre-fall injury."

Razak also grilled her on what he said were discrepancies between Pornthip's first and second reports. But Pornthip was able to counter each of his questions and spent time explaining to him and the court.

"If you say blunt object, where is the weapon," a frustrated Razak said. To which the quick-witted Pornthip replied, "I want to ask if you are a lawyer?"

Pathologists are tasked to investigate the scientific findings in a death while it is the job of police to hunt down the culprits and weapons used in a crime.

Razak also reiterated several times to the court that all 4 federal-government appointed pathologists had said Beng Hock's neck injuries were caused by a fall. However, Malik objected, saying that "During cross-examination, Dr Shahidan had confirmed neck injuries were pre-fall."

Brutal cross-examination

Apart from Pornthip, Vanezis,Dr Shahidan, Dr K Saravanan and Dr Khairul Azman Ibrahim from the Tengku Ampuan Rahimah Hospital in Klang, and Dr Prashanth Samberker from the Universiti Malaya Medical Centre had conducted the second autopsy.

In summarizing for the Attorney General, specially-appointed criminal lawyer Tan Hock Chuan clarified with Pornthip if she was ruling out strangulation as the cause of death, which she said she was.

However, she maintained her view that, contrary to Dr Shahidan's findings, Beng Hock's neck injuries were not caused by the fall. However, she agreed that his skull and anal injuries were the result of impact with the ground.

Coroner Azmil Muntapha Abas then grilled Pornthip on the her case studies, asking questions related to falls from height and the injuries that resulted.

He adjourned the hearing to September 1 at 2.30 pm after Gobind asked for time to study the 'suicide' note revealed by the Attorney General.

Beng Hock's death a symbol of injustice

Earlier, Dr Pornthip was greeted by loud cheering as she entered the packed courtroom. Many of Beng Hock’s supporters are attending the hearing, as to them, Pornthip’s testimony symbolizes the injustice of his death.

The 30-year old Selangor political officer, who was a former journalist, had died in mysterious and suspicious circumstances after overnight interrogation by the MACC. His body was found outside the MACC headquarters and it is believed he had fallen from its 14th floor office.

The MACC says Beng Hock committed suicide but his family and friends are adamant foul play was involved. They blame the MACC for torturing Beng Hock during interrogation and for causing his death. In court today were his parents and brother.

Federal-government pathologists, including Vanezis, say Beng Hock died from injuries due to a fall from a great height. Pornthip, who is acting on behalf of the Selangor government, has said there was an 80 percent chance of homicide. According to Vanezis, Beng Hock was conscious when he fell but the British expert declined to say it was suicide.

Beng Hock had been called in as a witness by the MACC in connection with a corruption probe against his boss Ean Yong and several other top DAP leaders. The probe is widely believed to have been part of a conspiracy plotted by Umno to topple the Pakatan Rakyat state government in Selangor.

Pornthip: Wound on Beng Hock 's neck caused by blunt object

The Teoh Beng Inquest has begun and star witness Dr Pornthip Rojanasunand affirmed her view that Beng Hock suffered extensive injury to his neck caused by a blunt object prior to his fall.

Under questioning by Malik Imtiaz Sarwar, the lawyer acting for the Selangor state government, she said she found extensive hemorrhage on the neck that could not have been caused by manual strangulation alone.

"Wounds caused by blunt object," she told the court, adding that something could have been pressed to Teoh's head or neck. She excluded the possibility the wound had been due to the fall.

Malik had begun by referring to her past testimony where she had said there was 80 percent chance of homicide gauging from pictures taken of his corpse.

Pornthip confirmed that at the second post-mortem, she did not touch Beng Hock's body. But Sungai Buloh pathologist Dr Shahidan did as she instructed and she was able to form her conclusion. The questioning is still ongoing.

Inquest Into the Death Of Teoh Beng Hock While Under the Custody of MACC

KUALA LUMPUR
Friday, 19th February 2010

Dr Pornthip's findings disputed By Sungai Buloh Hospital Pathology Unit head Dr Shahidan Md Noor

Dr Shahidan Md Noor

Sungai Buloh Hospital Pathology Unit head Dr Shahidan Md Noor, who performed the second post-mortem on Teoh Beng Hock last November, told the inquest into his death that the DAP aide died from a fall, disputing Dr Pornthip Rojanasunand's conclusion that he had been strangled or had his anus penetrated before he fell.
He also said he agrees with the findings of the first post-mortem.
Taking the stand today, Dr Shahidan disputed the testimony of Dr Pornthip, who was brought in last year by the Selangor state government to offer her expertise.
Dr Shahidan said that the bruises on Teoh's neck was a result of his fall and that there was no evidence of asphyxia and this was his conclusion at the second autopsy after Teoh's body was exhumed.
Soon after the government pathologist gave his evidence, lawyer Gobind Singh, acting for the Teoh family, rquested for a postponment of the inquest to study Dr Shahidan's findings.
Coroner Azmil Muntapha Abas then granted the request and ordered the inquest to reconvene on March 1.
Earlier, copies of the report had been presented to the parties concerned and the findings of the Nov 22 post-mortem will be made known today.
The autopsy was witnessed by state-appointed pathologist, Dr Pornthip Rojanasunand, and Malaysian Anti-Corruption Commission-appointed Dr Peter Venezis.

Murder suspected

Pornthip, a director of the Central Institute of Forensic Science in Bangkok, which is part of the Thailand's Justice Ministry, had taken the stand late last year where she revealed that the political aide's death was 80% homicide.
Pornthip is also expected to present her findings while Venezis, the famed pathologist involved with investigations into Princess Diana's death, will be presenting his.
Both Pornthip and Venezis are likely to take the stand after Shahidan.
Coroner Azmil Muntapha Abas ordered the second autopsy on Nov 9 following Pornthip's startling revelation.
Teoh died on July 16 after being interrogated by MACC officers at its Selangor headquarters in Plaza Masalam here.
While the official version is that the DAP political aide fell to his death, his family have, however, alleged foul play.

Reluctant at first

At the inquest that is being conducted now, Shahidan said he was reluctant to perform the second post-mortem as requested by Tricia Yeoh of the Selangor Menteri Besar's office and Gobind Singh Deo, lawyer for the Teoh family.
The pathologist said he asked the duo to write to the Health Ministry. On Nov 9, he got a call from deputy public prosecutor Mohd Abazafree Mohd Abbas ordering him to perform the post-mortem.
He said Pornthip and Venezis, along with the two pathologists who performed the first post-mortem, were present when the autopsy was carried out.
The post-mortem began at 12.45pm on Nov 22, and finished two hours later.
The post-mortem report, Shahidan said, revealed that there was bruising at the thyroid of the deceased.
There was also a permanent blood clot at the back of tongue near the neck, as well as bleeding on the right side of the brain and on the right side at the back of brain.
The pathologist was decribing his external examination of the body as he answered questions by government-appointed lawyer Tan Hock Chuan.
Shahidan told the inquest that scratch marks were also found on Teoh's left hand.

Breaking News On Teoh Beng Hock Inquest-Thai expert says Teoh’s death ‘80pc’ homicide

By Debra Chong
Malaysian Insider

KUALA LUMPUR, Oct 21 — Thai pathologist Dr Pornthip Rojanasunand told the coroner’s court this morning that there was an 80 per cent probability that Teoh Beng Hock’s death was homicide and not suicide, and suggested that some of his injuries were sustained before his fatal fall.
Under questioning from Selangor state lawyer, Malik Imtiaz Sarwar, Dr Pornthip testified that the political aide was indeed alive when he hit the ground but added that he was unconscious, judging from the lack of injuries to his wrists and ankles.
She explained that if he were still conscious when he fell, there would have been “reaction wounds” to show he had instinctively tried to stop from hitting the ground. She said that Teoh’s injuries showed he could have been strangled and that he sustained anal penetration before he fell to his death on July 16.
Dr Pornthip added that Teoh could have passed out as a result of the strangulation or from the pain from injuries to his anal region.
She told the court that the likelihood that Teoh had committed suicide — the theory previously put forward by the two pathologists who examined Teoh’s body after death — was only 20 per cent.
The stunning testimony made by the forensic expert, who gained international prominence from her work in identifying the 2004 Asian tsunami victims and more recently in the death of Hollywood star David Carradine, appeared to suggest Teoh was assaulted before his death.
Using a graphics presentation, the 54-year-old who has carried out over 10,000 autopsies over the last 27 years, told the court that not all the injuries sustained by Teoh were consistent with those caused by a fall.
The anal tear, which she described as a “penetrating injury”, appeared to have happened before he fell.
Dr Pornthip noted that the tear measured 6cm-wide by 2cm-long.
She rejected the idea that the anus was penetrated by a bone fragment, which had been put forward by local pathologist, Dr Khairul Aznam Ibrahim from the Hospital Tengku Rahimah Ampuan in Klang.

She reasoned that if that had happened, the force would have punctured the area opposite its entry and not as what was shown in the autopsy photos taken.
She suggested that they were caused by an object inserted into Teoh’s anus from a bottom-up direction, which she indicated with a blue arrow on a picture slide projected on a white screen in the darkened courtroom this morning.
“This kind of injury, I’ve not seen in cases of fall from height,” the director-general of Thailand’s Central Institute of Forensic Science (CIFS) said.
However, she could not say what the object was.
She also said that the depth of the tear was not measured or mentioned in the autopsy report.
Dr Khairul had jointly written the autopsy report with Indian pathologist Dr Prashant Naresh Samberkar who is currently based at the Universiti Malaya Medical Centre in Kuala Lumpur.
Several stripes on Teoh’s upper thighs, just below the buttocks were also pointed out as inconsistent with injuries caused by a fall.
Dr Pornthip suggested the horizontal lines were the result of a beating with a stick.
She added that if she had carried out the autopsy on Teoh, she would have cut open the thighs just under the skin to check for internal bleeding in order to confirm her theory.
She also pointed out several “round” bruises on Teoh’s neck, which could mean “manual strangulation” by fingers.
Her lengthy explanation on Teoh’s neck injuries was peppered with graphic references to her own case studies of strangulation victims.
The skull fracture on Teoh’s head, she said, was not typical of an injury from a fall, but more compatible with the result of blunt force applied directly to the skull.
“I found contusion on fracture line, so the fracture could be caused by blunt force injury directly on skull,” she said, explaining why she disagreed with Dr Khairul’s and Dr Prashant’s theory.
The two doctors who performed Teoh’s autopsy had previously put forward the idea that the head injury may have been caused by the momentum of the landing.
“For transfer of force, (you) only find ring fracture at base of the skull along (the) spinal column, not a linear fracture and not a cervical spine fracture,” she added.
She said that her assessment was based on Teoh’s autopsy report, the photographs of his injuries and from snapshots taken at the site where his body was found.
Dr Pornthip who had earlier suggested that Teoh may have been dragged before he plunged to his death told the coroner’s court after lunch break that she no longer held the view.
In her testimony earlier, she had contradicted Dr Prashant’s idea that it was caused by the impact on the ground.
She explained that she had been allowed to view the original pictures of the shoe, which are of a better quality than the copies she had been provided, and confirmed that the marks on the sole were indeed caused by the impact when Teoh landed on the hard and rough ground feet first.
She told the court she would like to carry out her own autopsy on Teoh, but magistrate Azmil Muntapha Abas who is acting as coroner in the inquest, indicated that it may be too late to do so at this stage.
Dr Pornthip had also previously sent two assistants to join the court to survey where Teoh’s body was found on a 5th-floor landing outside the offices of the Selangor branch of the Malaysian Anti-Corruption Commission (MACC) in Plaza Masalam here.
Teoh, who was the political secretary to a DAP state executive councillor, had been questioned overnight on July 15 to help an ongoing investigation into claims his boss had misused state funds.
Dr Pornthip was engaged as an expert witness by the Selangor state government. She had been among the first names suggested to carry out a joint autopsy on Teoh, but was rejected by his family whose reasons remain unknown. Earlier, she told the court that she had conducted over 10,000 autopsies in her career, of which more than 100 dealt with fatal falls from high places. She estimated Teoh to have died between 6am and 8am on July 16

Teoh Beng Hock Inquest-Tell Me If You're Still Not Convince that MACC is indeed a BN's Tool

I would like bring for the attention of all Malaysians and the the rest of the people in this world on how Malaysian Anti-Corruption Commission (MACC or can be meant Malaysian Anti-Chinese Commission or Malaysian Authority for Cow and Car) working it all out to oust Pakatan government in Selangor after they used the same strategy in Perak.
According to the article written in Malaysian Mirror, the total amount of monies donated to DAP by the four companies were RM 26K . How much is this compared to the RM10M donated by Datuk Seri Tiong to MCA. Did we hear any of the parties (donor and the recipient) being investigated by MACC until the wee hours?
Taib Mahmud the longest serving Chief Minister, was accused by international newspaper and al-jazeera recieving kickbacks and siphoning government monies worth millions of ringgit, but did we hear MACC started the investigation on him? MACC should start the investigation now and Dont wait until the old man died.DO IT NOW BEFORE IT WAS TOO LATE!
Continue your reading below.

(Malaysian Mirror) - The inquest into the death of Teoh Beng Hock took a political turn when allegations surfaced that four companies had given kickbacks to the DAP and some branches in Selangor. Malaysian Anti-Corruption Commission officer Mohd Anuar Ismail testified that the information was obtained from four documents printed from Teoh’s laptop and his recorded statement with Selangor MACC officer Mohd Nazri Ibrahim. Anuar, who took the stand again as the inquest entered Day 14 on Wednesday, said this when questioned by lawyer Abdul Razak Musa, who is representing the MACC. Approval allegedly by Teoh and Yong At the outset of the day’s proceedings, coroner Azmil Muntapha Abas had allowed an application made by lawyer Salim Bashir for state executive councilor Ean Yong Hian Wah to sit in the court so that he could listen to the testimony of the MACC officer. The late Teoh was Yong’s political secretary. Teoh, 30, was found dead at the fifth floor corridor of the Plaza Masalam here on July 16. He had been questioned earlier by officers of the MACC, which has its Selangor office on the 14th floor of the building. Anuar told the court that MACC investigations showed the following companies received projects that allegedly went to Teoh and Ean Yong for approval: (a) Fizami Construction (21 projects worth RM147,812) (b) Haris Enterprise (14 projects worth RM88,275.30), (c) MNKN Enterprise (six projects worth RM50,765) (d) MA Bina Melur (seven projects worth RM69, 010). Commissions to DAP and branches

Anuar said the investigation also found that four companies had given commissions to the DAP and its Serdang Aman and Bandar Sungai Long branches. He named the companies as WSK Services, Hong Chee Enterprise, Saharun Enterprise and Sharideen Enterprise. The commissions given totalled RM25, 546.56.
Lawyer Gobind Singh Deo objected to the line of questioning, saying that Abdul Razak had breached what was agreed on Tuesday, which was for the inquest to stay within the statement taken from Anuar by investigating officer ASP Ahmad Nazri Zainal. Gobind, who is holding a watching brief for Teoh’s family, said Abdul Razak was using the inquest as a platform to talk about the entire investigation by the MACC.
“We have nothing to hide. We can bring our witnesses and justify the allegations by Anuar. “His allegations are baseless. It is unfair for my deceased client,” Gobind told the coroner.
'Damage has been done'
However, Abdul Razak told the court that the result of the investigation by the MACC is important to establish Teoh’s state of mind. Government-appointed lawyer Tan Hock Chuan intervened and asked for a short break for all interested parties to have a discussion.
Gobind was not satisfied and again objected. “No! The damage has been done. “The allegations about DAP has been put on record. Teoh did nothing wrong. But this inquest has turned into a corruption trial of Teoh Beng Hock.”
MACC's night interrogations
The court granted a short recess, after which Anuar took the stand again to explain why the MACC sometimes conducts night interrogation. He said some witnesses who hold day jobs choose to be interrogated at night so it will not interfere with their work. He added that some witnesses choose not to be seen at the MACC office for their own reasons so they choose the night time to have their statements recorded. “The MACC office is open 24 hours,” he said. Asked by Abdul Razak why he did not lodge a police report straightaway after finding Teoh’s body, he said he believed the first person who found Teoh had done so. At the time when he saw the body, he said, there were already many people gathering on the fifth floor of the building.
Argument in washroom
To another question by Abdul Razak, Anuar told the court that an MACC officer, Bulkani Paharuddin, had told him that he had seen Teoh arguing with another witness in the man’s washroom at the MACC office at about 2am on July 16. He said the other person was Tan Boon Wah, a Kajang municipal councillor, who was one of the four witnesses present at the MACC office that night.
MACC and Abdul Razak, the lawyer that representing them must be aware that they are against the rakyat and not the Pakatan Rakyat. You are paid by the rakyat and not by Barisan Nasional..this must be made clear to MACC.
One day or less than 5 years from now, I am confident that Pakatan Rakyat will take over the federal government from BARISAN NASIONAL , by then we will re-open the file. To prevent yourself from being charged or come into trouble in the future, just do your work by the book.Dont become a dog for someone whatever the reason. Remember you have lost your credibility and people trust!
